Hi,
I have an California EB2 RIR LC app pending with backlog center with PD of March 2005. My 6 years of H1B are over and am an Indian citizen.
Is it a good idea to convert this application to PERM - my company lawyers say that there is a risk in that if the application is rejected, there is no back-up + it can take upto 8 months to process under PERM due to the conversion.

It is very true that it might take a long time for the conversion cases to get approved. Mine took 6 months with audit. Your PERM application must be identical (not similar, it should be 100% identical) to your RIR case. They will take months to pull your RIR out from the BEC and compare it with the new PERM and if 100% identical they will approve. It is possible. It can be done. I got mine done. It will take time. It is risky especially when your 6 year limit is over. There are ways to stay in status even if it gets rejected. But are you willing to take the risk?

Wow!!! I wish I could have attended this mesmarizing rally experience. Now can you guys come up with more data on who (Rally member) met who (Law makers / Media Persons ) and how those meetings were and what opinions you heard at least verbally. What we could successfully conveyed particularly to law makers etc...

No. The I-129 is submitted by your employer. Your leaving the country does not affect the H1 petition.
Only the COS will not be automatic in October, and you will need to get stamping or re-submit I-539 to validate your H1.

Even if one of the following items could be achieved, it will get us out of this mess. None of this increase any Green Card numbrs, even recapturing of unused Visa faced a stiff opposition last year, as they kept saying, you may call it visa recapture or whatever but for us it is giving 0.5 million new green Cards.

The three days were packed with drama - Like any good drama, this too had it's moments of tension, action, and humor....the funniest one was:
Right before the rally when Aman was EXTREMELY busy, he actually had 30 seconds for each reporter. Our sweet little Jane walks up to him and asks "Aman where are my clothes?"
Aman had the funniest expression on his face :confused:
Here is the background : All of us had stayed in the same hotel and at the check out time we had kept out luggage in the baggage room. Aman had the tags of Jane's bags and Jane thought that Aman would get her luggage @ the rally!

I have an approved H1B visa and was planing to start working for the new sponsor company 10/01/08. It turned out my current employer bought the company I was going to. My position is slightly different but in same line of business and industry. mY question is:
Do i need to file an h1b amendment for both position and company?

The Senate passed today Fair Minimum Wage Act, H.R. 2 today. The House passed this bill, H.R. 2 and the Senate debated the bill for the past several days. In the process, hundreds of amendments had been introduced on the Senate floor. The Senate floor then agreed to a lot of these amendments. One of these amendments which the Senate had agreed to and passed as Division B of the H.R. 2 is the Immigration Reform bill.

If you trust IV Core and its advisory board and believe that they know how politics works better than you and me you are entitled to your opinion and you may be right too. Certainly IV Core knows how political work, there is no denying that but my point of contention is that does what ICV Core believe and are working towards match with what is good for EB3?
And there as the bard would say lies the rub
Now again in response to that you and most of the people would agree that IV Core goals is good for EB3. Now out of all the people who agree how many are EB3 and how many are EB2. Again IV Core would say many EB3 agree with what they do because IV is not about helping anyone, IV is about helping yourselves (EB3 or EB2), and when it comes to the fact of helping ourselves i for one feel that IV core would do better to listen to the EB3 voice out there. Why do i feel EB3 specific voice is not being heard? Well the answer to that is very simple. It is because EB3 as a whole has NOT seen any benefit out of the rule changes which happened till now and any new initiative which gets the support of IV.

My commnts to that is that YES it is a harsh economic situation and YES anti immigrants sentiments is on the rise but if i am an an anti immigrant i would oppose immigrants as a whole. I would not oppose EB2 immigrants less because they have MS degrees and i would not oppose EB3 less because they are stuck in the immigration process and harsh economics time is harsh for everyone (EB2 and EB3) and also citizens so the same logic of anti immigranst sentiments would apply

What i like is not what is important. What is important is what is done is the right thing., If it is the question of EB3 waiting fore ever (say 10 years) or EB3 waiting more than forever (say 20 years) i would plum for which ever option gives relief to people (even if it extends my GC wait time) who are of older priority date and who should get relief, not because they have waited for so long but because they waited for so long in the line and followed all the rules and it is just mind blowing that people who have applied for GC in 2008 and 2010 and expecting that they deserve to get GC because they are EB2 and no other reason.
Now to that all EB2 guys will reply back saying Are you nuts, that how the world works, if you want a GC sooner get a US degree or apply in EB2 no one is stopping you and all that kinds of statements. Me and my wife are both on H1 approvals (F1-OPT-H1) and planning to go to New Delhi for our very 1st H1b stamping and I was wondering if I can do the same and Book just 1 appointment for me and my wife and appear before the VO together at the same time?

I think it made a lot of sense to me ... Here is the article in its entirely. It kind of matches with sobers and nyte_crawlers descriptions above ...

Once this is done, the guest worker would be provided with a visa issued by the State Department. The whole process will take a matter of one week, or less.

Anyone may apply for a guest-worker visa at the new Ellis Island Centers; indeed, the plan may actually work to the advantage of applicants who have never violated our immigration laws, since guest-worker visas will be issued only outside the U.S.
There will initially be no cap on the number of visas that can be issued; for the first three years, the market and the needs of U.S. employers will set the limit on the number of guest workers. But a nation without borders is not a nation, and across this country Americans are anxious about our borders.
Every night Americans see news images of people crossing the border illegally. They hear of people paying thousands of dollars to "coyotes" to smuggle them into the country; they worry that drugs will make their way into the hands of their children more readily. And they rightly fear that our porous borders make it more likely that terrorists will cross with deadly intentions against our families.
I believe that my Border Integrity and Immigration Reform Act is a solution that those opposed to amnesty and those who propose a guest-worker program can both support. It offers a solution that those calling for the humane treatment of illegal immigrants can embrace.

any experience from Indain Embassy at SFO ?
Got new passport on 3rd day for whole family. In India passport was done in Barielly. Gave application Mon morning in person and collected Wed evening in person.
I have used couple of other services (e.g. certificates, power of attorney, etc) of Indian Embassy at SFO and every time they have been best for me. Although some of people I met have different experience.

Well, asking who Hugh hefner is a cardinal sin for anybody who is a guy... God knows I grew up looking at his creations in a magazine until I met "my bunny".
