First of all, the topic of this thread is a total waste of time.
We hardly have enough support, funding, time etc. to fight GC related issue, and here people wasting time on discussing Citizenship! I am politely asking these people if any of you have contributed any of your time/money/effort to IV, Did you? Simply hypocrisy.
And top of that people in this thread are using extreme foul language.

Thank you very much mdforgc for your detailed response. I appreciate you taking the time to explain me. I have contributed $200 towards IV and am very pleased with the work of the IV core group. I hope we will continue the momentum we have generated and find a solution to our GC problems.
The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

I am little confused. As your wife is already in legal status (h4) till 09/2007, why do you want another extension when you switch job? As far as I know (I had similar situation in 2003), you can transfer your H1 to new employer and before her H4 expires, apply for extension with your new H1B (it may not be required even as she has already applied for H1). Once, I did exactly same when I switched job and I didn't had any legal problem with my wife/daughters' H4 extension.
Still I suggest you consult an attorney.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
So, I am not really sure how many of us are actually willing to fight ?!

They basically do not need greencard and Greencard is not important to them. Don't waste your energy trying to convince them. They are better off watching visa bulletins every month and blaming their karma. Our aim is not to have million members who do nothing and just criticize. But have a positive bunch that is sincere, committed and works to fix the problem.

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
The birth certificate you get from the Consulate is not sufficient for I-485. If you don't have a birth certificate from the Municipal corporation of the city where you were born: then you need a Non-Availability certificate from that Municipal Corporation + 2 affidavits from close relatives.
Check with your lawyer for more information.

At the outset, I fully sympathize with ur situation. It is just a pathetic state of affair and very unfortunate. It eats my heart out to see that future of our aged out children in the USA is affected by the stupid immigration rules and hence affecting their lives and career.
Having said that, if you are looking for IV or Core to do something about it, I would like u to consider few things:
a) IV is purely made up of volunteers and whatever any time we can get after a day long work or taking care of family matters , we dedicate to IV matters.
b) This implies, the issues that concern most of the people are generally taken on priority. Moreover, the unfortunate truth is that there is also self interest involved. Everyone is a victim here and would like to further self cause over other. If the self cause of majority is aligned, that makes into the agenda. After all, after lots of efforts if you get to meet any lawmaker just once for 15 minutes , which agenda would you push for?
Having said that I would recommend you to form a group to lobby your cause. I am sure IV will lend it support to let it run its banner. But the strategy, labor and money would be coming from the victims.
I have been continuously requesting in my previous postings that CORE Team should take up the issue of sufferings of children who have turned 21 and who could not file 485 applications due to visa retrogression. I do appreciate that this may not impact a large number of our members and CORE is committing its recourses for a much wider issue of over all visa number increase. However, getting visa number increased is a big effort and in current environment may not be achieved. However, getting CSPA amended may not e that much a big deal and if CORE team starts working on it, we may see positive result. As such, I again request CORE team members to take up this issue. I am prepared to lend my support in whatever way I can and I am sure there would be many other members who will be willing to do the same.

If Slumdog and his ilk is happy with their quality of life! Let them be. Just as xycgc mentioned, dont ever default and leave the burden to the rest of the citizens.

What we could successfully conveyed particularly to law makers etc...

You can just take the 5-10 lines from the report which shows wasted visa numbers from the past years and send it to all lawmakers from all states asking for visa number recapture legislation
I think its just one small paragraph the lawmakers have to insert - They can attach it to any major upcoming bill - This does not create additional numbers or change the existing laws in a big way.

the weired part is no email even though I have "Y" in the settings.. I just happened to check the status online and have the below message for spouse and I

Has anybody received something similar? Seems canned and asking to wait for another 6 months holy cow?What is the next step Info Pass?

GC reform itself is long process and jumping next step is not a good idea. Also having Gc and citizenship will not make much difference. Only difference is voting , a very few government jobs and staying out of country for long time. It may be Ok to wait 5 years for citizenship for most people though it is preferable to reduce the waiting time.Green card is more important to resolve many issues. Still last time there was an attempt to reduce the waiting period 3 years.
I am also struggling to get my GC. It is my 9th year in H1B visa. My intention is, atleast we can reduce the period for waiting to get the citizenship. It can also be considered as a good benefit for our community. Just my thoughts...

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Then please send an email to ivcoordinator@gmail.com (starsun) with subject - "I485 filing without current PD - Impacted Member". Include your a) IV username b) Email address c) Phone #, d) State of Residence e) Priority Date - so that grassroot efforts can be coordinated
2) Print out below Flier and circulate at all asian/indian malls/groceries/theaters. Forward the flier to your friends/co-workers and ask them to do the same.

Deadline = April 30th, 2011

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. I am on the same board. I am also planning the samething.
1) After 11 weeks that is next week Friday call the customer service and raise a Service Request
2) Within 2 wks no response, on 90th day I will walk into the local office (SFO) and ask for interim EAD.
3) If Still create the issues, packe the bags and go back to home country. It is really bad,
getting frustrating for everything no regulare process and always waiting.
So I give up, I applied on april 1st and still waiting no updates:mad:

Thanks for correcting me :) yes the Antibody titer test
And yes both me and my wife got it done. In fact my wife just got this done today.

So what you are saying is, if one does not has the Vaccination record, concern DR would do this immunization (Antibody titer) test in place of vaccination record and can you confirm that you have gone thru exact scenario ?

Did you notice any LUD? I noticed soft LUD just now, but nothing in case status. Check this thread (http://immigrationvoice.org/forum/forum5-all-other-green-card-issues/1599300-action-item-for-i485-transferred-case-members.html). I had to do submit AR-11 for no reason. Not sure whether LUD is because of that.
