We had another interesting call this week with some new members on the call. This was the second call for the Northern California chapter and we are developing some goals and plans to achieve these goals.
We have setup a yahoo group to facilitate communication within the group and to keep track of our various efforts.
The yahoo group will contain a FAQ on meeting your local lawmaker.
There will be a spreadsheet of Northern California lawmakers where members can volunteer to setup a meeting with their local Congressman.
We discussed putting some formal structures in place to make people accountable for specific goals and to allow volunteers to focus on specific tasks.
Our volunteers with experience in marketing will develop a plan to publicise out name and goals.
We discussed a proposal that we meetup in person in mid January. This meetup will be the official launch of the state chapter.
The next meeting of the Northern California chapter will be announced before Wednesday December 6th.

My Situation :My current AP is expiring on Dec 15th 2010. I need to travel around Nov 10 th for 2 week I will be returning back in last week of November. Also I have applied for my renewal of AP in August 2010 which is till pending.
My question is : If I don't get my renewal AP approved till Nov 10th Will it be okay to travel based on the AP which is valid up till Dec 15th
Any answers will be highly appreciated.

1. can a person use EAD to get DL eventhough current legal status is H1 or H4?
2. If we use EAD to work, can we still use H1/H4 extension (I-797) to get DL?
Basically my question is whether we have to show current legal status (H1/H4/EAD) papers ONLY to get DL? or any valid legal paper is fine.

What is 'C' company? I have heard of 'D' company (Dawood Ibrahim Company).
'D' Company does not file Green Cards for sure!!
You will get a 3 year extension with new employer as your I-140 is approved with your current employer.
Mar-08 may not be current in next year to file for 485. So the new employer will have 1-2 years to apply for labor and I-140 for you and you still wont lose your number in the queue or miss the boat. Make sure they port your priority date when applying for I-140.

It doesn't matter what the attorney is saying, because USCIS takes decisions based on their own regulations and memos, and not the advice given by Immigration attorneys to their clients based on their interpretations.
I have not come across any Memo, FAQ etc. from USCIS clarifying this point. It's a legal grey area just like whether a person can continue on H1 after using AP. Every attoney out there has his/her own opinion.
I'm not championing any view. I will be happy if AC21 could be invoked on RD. However, I would be interested in seeing the USCIS Memo, FAQ, or USCIS Field Manual for Adjudicators section clarifying this rule. Newsletter from an attoney will not do. I want to hear it from the horses' mouth.

Happy to share the news that I received an email saying that "card production ordered" for 485 yesterday. Technically I got greencard approval, but I have not received the card in mail.
However, here comes tough situation along with the good news. I have tix booked to leave to India tomorrow. I'll be return in 3 weeks. Lawyers suggested to go to Infofass in Boston (nearest to where I live) and get my passport stamped with 551. I checked the appointments and there is none available for today. Is there any emergency appointments. There is no phone number available for InfoPass/Boston.
My AP is valid till this December. So can I use it. Lawyer suggests not as there will be intense scrutiny. Horror stories and happy stories shared by friends about friends who were in similar situation.

This yr I need to file jointly. Got married last year and my wife is on H-4. I am told I need to apply for ITIN Number and file via paper only.
Can someone who has gone through this process shed some light? is this something that can be done by an individual?. I have filed taxes before on paper and via websites.

This jump is not because of super-processing. It's because concurrent I-140 filing (without current PD) are neither being processed, nor being counted as ready to be processed. If your I-140 filing was non-concurrent, good for you! Neat trick to move processing dates forward without having to do any work.
If you don't know what I'm talking about, google "Plust Pilot Program".
Is this true that for the concurrent filers who filed in July would not have their I-140 processed until their PD is current ! That would suck because without having the I-140 cleared no one can make use of the AC-21 provision.
Can someone shed some light on this pls.

From data it seems like Nebraska is firing at all cylinders and Texas is stuck in 1st gear for EB2 cases. I read Googler's post, while it makes sense it still does not explain why there are so few cases being approved from TSC as compared to NSC.
Any insights into this anomaly?

I see a lot of people are getting Canadian immigration these days. Isn't there a rule that after getting the green card you have to land in canada within 1 year or you loose your perm residency status? The reason I am asking is that I am planning to start canadian GC but want to finish my full quota of 6 yrs on H1 (3 yrs left right now ) in US. So, if I file now and (let's say) get my GC within 1 yr, plus one year to land; means that I have to leave US before my 6 yr term expires. Is that right?

In the current scenario, I dont think it is "admin" delays that affect the EB immigration. The main issue is incompetent and illogical "laws".
Well we have to sometimes acknowledge the "good" also. USCIS & FBI did a great job in solving many of the "administrative" delays in the past.
1. FBI checks are faster now.
2. USCIS processing is faster now.
3. Labor processing is faster now (compared to 5 years for LC approvals).
So I believe the major issue is not "administrative delays" anymore (for EB immigration). Sure, there is always slot for improvement.

I also read somewhere on another thread that you can walk-in if you can prove your emergency. Take proof of travel with you (plane tickets).
