I've got an employer in the US that wants to get a Labor Certificate and apply for a green card on my behalf.
Is it possible for me to travel to the US on a tourist visa and then there apply for the green card?
Will I be allowed to stay until my application is either approved or rejected?

My understanding is when FP is done they take all fingers of one particular hand once and then individual fingers later for the same hand.
The Match (%) is for match between all the fingers taken at once and then individually.
And they need to Match 50-60% or more, and thats why retries are done when Match is not found or is a low percent match. For Fingers that match the prior finger print (for full hand) comes up with Match Found! not an error but indicator for the person doing the FP to move ahead with other fingers.
It has nothing to do with any database at that point of time.

I went for my second FP today coz they messed up my first FP. The guy this time was MUCH MUCH smarter and explained the process to me. He said that first they take 4 fingers and then individual ones. On a lighter vein. This time everyone there was using "Windex" to clean the fingers and the glass on which the prints are taken. Remined me of the movie "My big fat Greek Wedding" where Windex is used as a cure for everything. Certainly seemed to work for me today (i hope and pray) ;)

i have never seen anything like this before.... simply awesome...... when i was going for this movie.... i thought this is another much hyped hollywood masala movie, oh man.... this turned out to be something..... never ever seen anything like this...... if u haven't seen it yet... try to watch it in 3-d imax.... nothing like it.... i can tell u its an experience u don't want to miss.... its not half the fun on non 3-d or non imax..... my friend had seen it last week on non-3d imax.... & he said it was not even 1/2 the fun it was to watch it in 3d imax....

Didn't notice that the passport was still in my jeans when I did the laundry:( The passport ID pages don't look damaged but the picture on the visa page looks fuzzy - & I just got my visa restamped 3 weeks ago! Anyone knows what the procedure is to get a new stamp? The consulate pages mention only about lost passports

I think this is a really bad idea. Green Card is fine.. but remember, we are first Indian, Chinese.. we are citizens of our countries..and owe allegiance to it....atleast till the time you get your american citizenship.
I was hesitating to say that. But you said it. People please don't get me wrong. Yesterday went to my son�s school for "back to school night". Before anything starts they have "pledge of allegiance". But my friends mom has terrible hands and I had taken her the first time, but she has been called the 3rd time for FP. Also I have worked in Labs where FP is analyzed, they suggest if the hand is moist, it is easy to take prints. So please do not blame the Service Center people please be humble and accept their services gracefully and if needed put some vaseline on your fingers and do FP again.

will add that information to their data base and when the USCIS sends
fingerprints your name will get more than one hit which mean that your

manual check on every hit.

I ask everyone who is trying to learn more about their namecheck to document absolutely everything about their correspondence with the agencies and congresspeople. Note down names, badge numbers of USCIS information officers, times, and all details about the conversation. The courts are taking a dim view of misinformation, lack of intent to adjudicate and the subversion of the intent of congress. Everything you can do to show that you tried your best to
(a) resolve the issue without coming before the court
(b) get information and were given contradictory or false information
is helpful in a mandamus lawsuit.

Can we push for treating first entry in USA on H1B status as Priority date subject to maintaining continuous H1B status all the time with casual absence (vacation)?
Will this be a legislative change or administrative?
Thoughts? Ideas? May be some red dots? :D
So what we have to for the CP guys which will enter US with green card? Someone came 1995 went back India. Now he comes back to US 2009 his priority date is 1995. Then people will start to say number of days spent in US.

Thanks for your response. My question is: Would the employer have to cancel I140 along with H1B? Also, do they have to cancel H1 as per law if an H1B employee leaves? If my employer knows about cancelling I140, they will surely do this to harm me.

The I 140 can be withdrawn by the employer any time (even after approval). Its withdrawal by the employer doesn't matter 180 days after 485 is filed if you can switch your jobs to a similar category mentioned in your labor certification/I 140 (either H1b transfer or EAD).
If you can't leave the employer on good terms you should transfer H1 (there is no need for approval before changing jobs). Merely filing H1b transfer with the USCIS allows you to work.
If I 140 is approved you should probably try to use the priority date to file for a new I 140 with the new employer.
This is the inherent problem with H1b .The employer can terminate your H1b (following the notice in your contract) and inform USICIS and also withdraw your I 140. Can't do anything about it.

Hello,
I was late in filing my EAD. I filed my case in Texas Service Center only about 45 days in advance of my expiry. I admit it was huge huge... mistake on my part. Now my EAD expired last week and I am out of my job. I might lose my job for good if the processing time ends up taking the standard 90 days. My employer has told me that they will simply not wait beyond 2 or 3 weeks.
I have tried the following things to get my case expedited and it has not worked.
1. Called USCIS and put in a request to expedite my case citing the personal financial loss. My request got denied saying that there was not enough evidence in my case.
2. I was advised by the customer service rep to draft another letter and send some evidence to expedite my case. This time around I drafted a letter to expedite my case citing personal financial loss and humanitarian reason. I enclosed my checking and statements showing my cash balance and also statements of all my debt obligations such as mortgage and credit card balances. I also enclosed receipts of prescription medication that I am taking for high blood pressure. I have mailed it and I am still waiting for a response.
3. I tried expediting through my local congressman's office and that got denied too saying the process has not gone over the standard 90 days and they would not do anything about it.
4. I made an appointment at the local USCIS office and tried plead my case and they too were not willing to help as it was still under the 90 day standard processing time.
So, so far nothing that I have tried has worked. I wanted to reach out to folks here to see if there were/are others in the same boat as I am. If so has anything that you have tried worked? Anybody has any suggestions on what else I could do to get my case expedited?

On one hand we want to hasten the GC process so that we can become citizens and enjoy all the freedom and benefits, and on the other hand, we are hesitant to sing the US national anthem?
Anyway, not everyone has to sing the anthem. I know the words but I find it too difficult to sing it anyway. But there is no harm in someone else singing it to show respect.

I heard in conf. calls and also on read on some websites that you can file for three year extension at your new employer also. You would need proof of I-140 approval.
