Folks ...
(1) Majority of members on this site and every other immi site are people who filled 485. Its just simple because those are the people who have wait so long and need more advise for EAD , AP , AC21 , H1b renewal with AP and so on..... I am not only saying that those AOS fillers are not interested in pre filling but also there is lack of interest in people who didnot file AOS and have nothing to do with immigration right now.. NO EAD , NO AP renewal... etc..
(2) Majority of people in this world are selfish.( Count me in too ). Thus people will be more interested for AC21 , AP renewal , EAD renewal. etc..
(3) We need lobbying and huge money. ( Even IV is struggling for money with 30k members ( again 80 % of them are AOS filler whose spouse can work now..)
(4) Personal experience... ( I was the one who started survey in March... didnot go beyod as got response from some 50 users... Not enough people folks.)
with all these conditions... I believe only VISA RECAPTURE will work.It will clear old people from queue ( Now USCIS has almost 165k pre adjusted 485s ) . and give opportunity to us for AOS filling.
Now when VISA recapture will happen....
If CIR happens and we are added into CIR. Other than it just enjoy summer !!!! and sleep for 2-3 years ... as USCIS is now waiting for EB visa numbers and they may change their processing focus on some another load.
Last year they were focused on Citizenship cases , this year EB cases ,, may be next FB based cases ...

Please refer to http://www.ssa.gov/pubs/10002.html#how and check out Application For A Social Security Card (Form SS-5) under How do I get a number and card? You need to fill out this form.
This form has list of documents you need to get a SSN card. Generally you need to carry your Passport and EAD. They will return all the documents at same time. They won't keep the documents with them and they need all original documents. They donot accept Copies. Hope this helps.

I am in a similar situation. Applied 485 for me and my wife. In the past, she has had more than a year of unlawful presence. But since her last entry into the U.S, she has been maintaining legal status on h4.
I spoke to lawyers about this issue. If the officer overlooks past overstay, we are good to go. If he finds out (legal immigration history is the basic thing they look for), we are in trouble. Could even incur 10 year ban!
People are advising here that if one maintains legal status since last entry, they should be fine. That is not true. To have made that last entry into the country, they must have obtained a visa at the consulate. And on the application form, it clearly asks if we have maintained legal status in the past. Mostly, people mention "YES". This leads to perjury for providing false information. Hence, the visa granted stands invalid.
In all this mess, one has to remember that 245K covers 180 days of unlawful presence. One with unlawful presence beyond 180 days must rely on pure luck.
Good luck to me and all that are caught in this mess.

As soon as they see the "Temporary Tag" with a "Check CIS Status" comment on the back of license, some of them seem to freak out and some seem to jump at the opportunity to harass a immigrant.
Which state license do you have? Mine does not have any comment about any "Check CIS Status". It's just a normal license, only difference is the red letters.

Here is my situation:
1) My 1-140 is approved(Approved on March 30th 2007 EB3)
2) I-485 is filed on July 27th(Have got receipt notice)
3) Have 3 yrs H1B extended recently till June 2010.
4) Application is only pending 3 months, and my employer may be thinking of laying by moving operations to India.
5)So, i may not have Job after Oct 31st from same employer so, I'm trying to find out what are the options available for me.
I have not applied for AP or EAD. I will be doing in this coming week.
Any input would be appreciated.

USCIS accepted my applications and sent the checks for the fees back with comment "A non-required fee or biometrics fee has been received. The fee is being returned and your application/petition is being processed."

Hi Guys,
I am new to this forum and a non technical (law) guy. So, please pardon me for any mistake in words i put together.
Here I wish to discuss and invite suggestion on a issue, which happened with one of my friend coming from INDIA.
That guy works for an IT company in INDIA as a software engineer.
He had B1 Visa with him. He was travelling to Philadelphia for 4 weeks (1st time flier to USA) for assessment (technical) of a new business proposal.
He was sent to second level scrutiny at the immigration.
At the second level, he was asked for clients contact (after taking his statement - that he is here for initial assessment), which he did not have, so he gave contact of his company's local (USA) sales manager number, who confirmed to my friends statement (on purpose of visit).
Immigration office then took client�s contact from sales officer and contacted the client.
The guy from the client side gave a contradictory statement saying, my friend is there for work (fine tuning and all).
This led to immediate interrogation of my friend for over hours. he was not allowed to contact\inform anybody. He was not given chance to prove non-guilty.
he was immediately booked under section 212(a) and 235(b).
His visa was cancelled and was scheduled to return to INDIA.
He was kept in a jail cell for 26 hours with no food.
He wanted one chance to clarify with client on confusion, which was denied.
After there decision and signature on statement\order, he was allowed two calls (one to local contact and one to family). This was after almost 14 - 16 hours.
He wasnt treated well there and was not even allowed to move\stand in the cell.
Now here, I wish to understand, how can we get this order reversed?
What all actions we can take to repair the things.

There are two pints made in this video. I think that the second point around saving third world population is ridiculous. He needs to clarify what he is talking about. The people from the third-world who migrate legally to USA are the once with qualification and experience that USA rquires and these people would be probably much useful in their third-world countries.

Gurus,
I am having trouble with my employer and the situation could lead to my layoff very soon.
I filed my I485 this July 19, and hence, still have some time before I can use AC21. My I140 is approved and I just received a mail yesterday that mine & spouse's EAD cards are approved and I expect to receive them soon. I have about a months vacation hours accumulated and I wish to use these to search for a new job.
I would appreciate if someone can answer the following questions:
1) Can I use EAD to join some other company at this stage? If yes, I believe the job title & salary has to be in similar conditions.
2) If I leave my present company, would the employer know that they need to withdraw I140 (My management is quite dumb when it comes to these matters but they know that they need to inform USCIS when H1B person is terminated)
Please suggest the best course of action for me. Your help is truly appreciated!

If an I-140 is approved, then that LC will be no use to someone else.
However, if I-140 is applied and revoked before apporval or during processing, then LC can be used for someone else.
Remember LC will not be for a specific person's name. Rather it's for a profile of certain job type and skill set and experience.But I-140 will be applied with a person's name attached to an LC. Hence if an I-140 is approved, the LC is done for it's lifetime
I was under the impression that after an I-140 is approved, the underlying labor certification cannot be substituted even if substitution is not made illigal. Correct me if I am wrong!

My personal thoughts: It is better to use Vonage as its a giant among the VOIP companies, has been around long and with sheer number of users, they can afford to contract to a better international carrier (to provide better quality).
As far as lingo goes - read the fine prints; for so called calling from mobile, they charge 79 cents for each call from cell phone and charges 15 cents for india for each additional minutes after first 10 minutes. Legends like Reliance IndiaCall or Tata Trueroots is way cheaper in this case.
'Lingo Unwired' offer is still cheaper for those who directly uses wireless carriers to call international.
In the end its your call - the above is just my personal view.
