I filed for 485/765/131 etc on 7/19 via overnight to Nebraska
They received it the next day 7/20

But I have not received any receipt notice yet.
No checks have been cashed too.
So called USCIS at 1-800-375-5283
Then selected options 1, 2, 2, 6, 2, 2, 1
Someone came online immediately.

She said that if no checks have been cashed, and because of the frontlog, I have to wait atleast 90 days.
After which I can then start an enquiry about why I have not received a receipt notice.
So I am going to wait 90 days.
Hopefully I get the Receipt Notice by then.

AS I shared my experience earlier, in order to continue on H1B, amendment need to be filed. Even if spouse has valid H1B and entered using AP, Same thing applies even though she is dependent.

Agree: I also strongly suspect that honoring the RD is BS that USCIS is dishing out. I feel they are selecting cases based only on ND and approving them randomly since all their systems, tracking, receipt # seems to be based on ND and not RD. Historically the ND and RD were only a few days away from each other and so it didn't matter - but thats another fight.

dont bother fighting them, you'll get nowhere. Also, you might need them for reference, or might end up working for/with them in some way or the other. Filing GC is NOT a requirement for them by law, and this "based on performance" is a very generic term. Now if they dont pay your salary "based on performance" its worth fighting, but in this case I dont know...
You and me are no experts in these matters... thats exactly why i suggested him to talk to an employment discrimination lawyer - only sure shot way to find out if something can be done, you never know...
then again its up to him if he wants to go to this extent - if it was me i would definitely do it ;)

180 days is just a guidance. I think its up to the officer handling the case to interpret it. Its always advisable to leave country as soon possible to adjust status. Consult your attorney and file with all kinds of documentation to support your case and hope for the best

Billu, don't do that mistake. If they are lucky then they will get in if not then the consulate will simply cancel their appointment and ask them to reapply again. In that case, they will have to pay for the visa fees all over again and go through the entire process. I think you should take this issue to your local congressman and the senator. That is the best solution and I do not think IV will do anything for this since this is completely an administration issue with the Delhi Consulate. Summer time and too many people are applying for the visa and less staffs at the consulate too.
So do not select English and ask for a translator.
Speaking by experience..Delhi/Mumbai always has translators..thats just how it works there..the only way to get an appointment is to take it in English..go there and ask for a translator..no senator/anyone else can help in this matter..it's pretty straight forward..good luck..

today My AP renewal application had status change. Status has below details; Does it means it is approved?

Did you file originally with an Attorney of the company?
Did you change attorneys after you switched. How did you go about doing that?
If not , your ex employer will get the RFE.
I have moved employers but not invoked AC21 yet as my lawyer suggested not to do it. Today I got an email stating RFE has been sent. Does anyone know what do they normally ask in such cases?

I was also in the same situation , my EAD is expiring next week but i got mine last week and i did not have 90 days. I approached Congressman and i got it through him. I am not sure why that rought is not working for you.
try to call the congressman again and explain him the situation of loosing job, family to be supported etc. and see what they say.

forget about your employer and job, for you to be in status you have to be working. The only way that I can think of you working legally is through H-1B's in non-profit organizations like state universities or state hospitals.
This does not come under the regular cap of H1-B count, so you can apply anytime and work. Ofcourse, if you need to move to the corporate world in future, you will need a new H-1B.
