I don't know whether 140jibjab is actually guilty of domestic battery. If he/she is, I am incensed that we are helping someone charged with domestic battery. Why would you beat up your spouse?? And then have the guts to ask for help in a public forum.
Well, no one knows and I think no one except his lawyer has right to know what really happened in JibJab's home. All I know is that the truth can be anything. Possibly he/she has beaten up his/her spouse. "Battery" suggests throwing something at someone. Like an object you hurl at someone.
But again, there are people out there, who press false charges in order to gain leverage in divorce proceedings and there are people who press false charges just out of revenge. I dont know what happened in this case, he/she could be guilty or may not be, and none of my business and none of anyone's business.

Your change of status happened when your H1 was approved from the Start date in Oct 2008
That means you are no longer in H-4 status. If your employer has not paid you since Oct that is illegal. The employee has to be paid or terminated. What your employer is doing is not legal ( there is no bench period for H1 employees ).
You can try to get back on the H-4 status by applying for change of status and hope that it is approved.
Desi3933 raised a good point. If you never reported to work the question of termination does not arise and your employer can always say that you never reported for work. If that happens your whole stay from Oct 2008 onwards could be deemed Illegal stay.

So if one is working on H1B, has a valid EAD, gets laid off but the previous employers does not revoke his 140 and is past the 180 day deadline for 485 filing should be fine I guess.
The other question is: under what circumstance would an employer wish to revoke the I140? Is it required by the law but not strictly enforced or is it just so that the employer may use it for another employee?

A good lawyer always follows rule laid by USCIS. Every officer is not expert in rules and regulations.
Consequences may be RFE and then one need to prove that it was not his/her mistake. And then USCIS will start doing mass screening (in fact this is happening with clients of couple of lawyers - we have some of the threads for it).

For my I-485, the Receipt Date is 5th July while the Notice Date is 5th September.
My question is -- does the 180-day count start from the Receipt Date or the Notice Date. Since there is a 2-month difference, this is a fairly significant issue.
Appreciate a response from anyone who knows.

If every one of the attendees - put a sheet of paper printed with a US Flag, and a serial number and below which says - Waiting for GC since this date.. would show the number of folks impacted and also differentiate in the crowd ?. (like foot ball team players ?)
We can also have a stall selling iV gear and if folks can pin up the sheet of paper with their serial # it would show the big number and differentiate us from the folks who are taking time off to see the MALL.

Assuming my employer revokes the I140 and I switch jobs using EAD and never file for AC21, I believe USCIS will wrongly deny I485 on the basis of the I140 revocation.
What will be my status while I fight the USCIS saying that I have used the AC21 provision. Since I won't be on H1, am I considered out of status at that time?

is there a easy way to lock down "Ask a Lawyer for FREE" for lawyers replies only? i.e members should be able to ask questions, but only lawyers should be able to respond. If members want suggestions/thoughts from other members, they can always post in other areas in the forum.
If there are many replies for the questions with partially correct (or incorrect) answers, IMO it makes it hard for lawyers to respond.

Is it ok if I ask which lawyers? Coz my lawyer said to be on the safe side it is best to wait for 180 days from the notice date.

this is first time i have attended a rally. it was a great experience. our members have educated quite a few DC visitors / American citizens about our problems during the trip from Washington monument - capitol hill. handing over roses to pedestrians also was a nice idea. who ever came up with the idea it was great!
i feel as if i have come out of the closet and fulfilled certain responsibilities. thanks to all the volunteers/marshals at the rally.
a special thanks to the IV members for providing the necessary directions / tips with Washington DC commute. that was helpful.
in the coming months we should see the results of this rally. i have no doubt about it.

Only the old passport would be cancelled not any valid visa's within the old passport. Just use both passports for travel from now on and you should be fine.

Just to update folks, for 2010 - when properly handled I have seen virtually 100% approvals when there is a 3 year bach + 2 year MA + 5 years of work experience as = MA for EB2. AIME = BA and + 5 years work = MA for EB2. When the PERM requires MA the 3+2 = MA for EB2. A 3 year bach+BED is considered a single source degree for EB2.

I have already received my biometrics notice on 04/21/2008 in the mail after filing.
I just sent my documents yesterday 04/21/2008.
I have sent
1. Original EAD paper in which my EAD came.
2. Copy of my I-485 receipt
3. Receipt notice of Efiling of EAD ( Which gets generated after you file)
I havent received approval, but I guess that is all required to prove you are eligible for EAD, Since you have a pending I-485 case.
