While i got my AP last year i did get it very late. I had applied in June and i got the AP in December and based on my application, this is what i found out
CIS (Both Texas and Nebraska) will recieve you AP and store it but will not start the AP processing until unless you specify the travel date soon.
In my case i applied in June but the AP document stated travel on December 15th. While i did get the receipt number within 15 days nothing happened on my case till december 1st. That is when i saw a LUD on the case and received the AP within 15 days

ENVY.
I am starting this thread to discuss why/why not USA need Illegal immigrants more than Legal immigtants. I want to see why one group should be favored over the other group from an American prespective.
Some of my observations:
Illegals are seen as
Law breakers, Will do the dirty work that americans will not do, will work for less than minimum wage, exploited, harassed, 12 million in number and so need support.
Legals are seen as
Take away american jobs, make more money than illegals, will bring down white collar wages down and so on and do not need support.
The above sentiments may drive what is happening in the Congress.
Your Comments? Observations?

O Ya! It will screw your GC process. Once your Canada immigration is done, Canadians will put a stamp on both cheeks of your buttock...saying..."immigrated to Canada"!
Coming back to US GC, before issuing GC, US immigration officer will ask you to come to local USCIS office and they will have a good look on your buttock! If you find that Canadians stamped your buttock then you will have to take shower with either LUX or HAMAAM soap to get rid of that stamp right at USCIS office.

I am having trouble with my employer and the situation could lead to my layoff very soon.
I filed my I485 this July 19, and hence, still have some time before I can use AC21. My I140 is approved and I just received a mail yesterday that mine & spouse's EAD cards are approved and I expect to receive them soon. I have about a months vacation hours accumulated and I wish to use these to search for a new job.
I would appreciate if someone can answer the following questions:
1) Can I use EAD to join some other company at this stage? If yes, I believe the job title & salary has to be in similar conditions.
2) If I leave my present company, would the employer know that they need to withdraw I140 (My management is quite dumb when it comes to these matters but they know that they need to inform USCIS when H1B person is terminated)
Please suggest the best course of action for me. Your help is truly appreciated!
If I were in your shoe, I will explore options where I can go on unpaid leave of absence. For example, some companies allow to take unpaid leave of absence to take certain courses, or to take unpaid leave of absence to go and take care of elder parents, or any sick member of your family. Some of these laws are mandatory to follow. For example in state of NJ by law, you can get upto 12 weeks unpaid leave of absence to support your family members. Just try to find one of those clauses and see if you can invoke one of those. You are just buying time here and the end of such period you can go back and resign from the company. This will maintain you employee status with your employer.
Falling back on H1 may not be a good option for you because you will have restart you GC process.

I had filed through attorney and I did submit last 2 (or three, dont remember for sure) years of W2s and tax return copies.
Also had give last two months of pay stubs...per lawyer's advise.
Did not have any problems.
Not everyone gets an interview; however everyone gets biometrics notice and you go to Application support center for fingerprints and picture.

I did get my passport renewed in 14 working days at the Indian Embassy, DC without any followup. I live in NC and driving up to DC to check up on my status was something that I wanted to avoid as far as possible. Not sure if they are really as incompetent as they are made out afterall.

I am a physical therapist. I might be wrong, but as far as i know we dont need to have labor certification unless something's changed. Am i right?
How long on the average is the I-140 process? it requires PERM to be done first before I-140 right?
Your answer is a light at the end of my gloomy tunnel---i appreciate it. It gives me hope to keep on trying and not give up.
So what i need to do now is and please advice me:\
1. Negotiate with the employer to use premium processing for my H1B transfer
2. Start the Green Card process as soon as possible--like NOW!
One clarification---If the I-140 gets approved...then I can extend my H1B even if im nearing the end of my 6th year---right?
If Physical Therapist occupation is still listed under Schedule A, then you should be able to file for I-140 directly without labor as long as you have an employer willing to sponsor your green card. I heard that PT now requires a masters (depending on when you graduated), but I am not sure if this is completely correct. It would be better for you to do some more research and talk to a good lawyer.

Not to defend anyone, but now its getting more and more worst... Because of these body shoppers or desi consultants, whatever you call them, the whole immigration system is at risk.
They are making lot of money by putting our future at risk. To me its time to disclose them to the US authority.
We need to stop them abusing the system....
I agree, its time they closed shop and the system got cleaned up. Well it's already started to happen, at-least something good has come out of this recession

I don't think the lawsuit is feasible.
Get the numbers for last 10 years for the immigrant visa numbers allocated to India/China. Since numbers are more than allocated under quota, there is no legal ground to file the lawsuit.

Here is my situation. eb3 labor/gc process started in dec 02.
married in 2005. applied for 485 in june 07.
wife has been in depression since march, and recently psychotherapy sessions have revealed that its a case of "hidden personality". she is not interested in marraige/family life and wants to pursue a strong career and be independent. Since she has had a previous "self mutilation" incident in life, psychiatrist is advising me to let her go or she could spiral down more into something more disastrous.
problem is, her family is not ready to accept this and they just pushing her to rethink, make it work etc. so wife doent want to go back and wants to continue to live & make career in US. Due to difficulties with getting H1 nowadays, im ok with keeping her dependent till GC comes and then think of legal seperation (divorce in india / US -whatever is needed). Since she seeks independence she is guilty to take my gc, and i think she will try her best to get herself a h1 next year. but i dont know where this will end.
after GC, if there is seperation will derivative spouse get to keep her GC? is there some standard "soaking" period during which she cannot untie the relation. ?
Pls advice.
