Hello IV members. I have heard about this group and this is my first post. I recently wrote a letter to the president. I am unsure how much it will change the current EB3 retrogression, however I hope that things will start to change for the better. I'd like to share the letter with you here:
Dear President Obama,
Thank you for taking the time to read this letter as I am sure you receive many. I am writing to you in hopes of promoting change to an issue that is close to my heart, and I believe close to yours as well.
As of November 2009, the current visa bulletins show a backlog of green card approvals all the way back to June 2002 for the employment-based third priority applications (EB3).
The effects of these delays are significant. EB3 consists of many young graduates such as myself, who graduated at the top of our class, who had to compete above and beyond the qualifications of regular graduates at every step of the way, who, like many former immigrants who came to America to seek a better life, are forced to make tough decisions in the face of these long waiting times. Some of us have been laid off, only to be given unrealistically short timeframes to find another job or go back to our home countries after decades of living abroad. Many of us simply wait in fear. Fear of the unknown and what might happen to us in the long years to come. In some ways, these restrictions stagnant those who foster ideas of entrepreneurship by preventing career change, growth and the risk-taking nature of American entrepreneurship that so evidently fuels the spirit and prosperity of this economy.
Intel, eBay, Yahoo!, Sun Microsystems, Google and many other companies were all founded by immigrants who were welcomed by America. Over the last 15 years, foreign nationals have started 25 percent of U.S. venture-backed public companies, accounting for more than $500 billion in market capitalization and adding significant value to our economy. There is a wealth of talent and ambition hidden below the covers of these immigration laws.
I arrived in Boston when I was 16 and I still remember the day I graduated (I was 20 and still couldn�t have a drink because it was illegal!) in 2004. Last month I turned 26, and I realized that I have been here for over a decade. This is the longest I have lived in any country since being on many diplomatic missions around the world with my father. When you were young, your family also lived overseas, so I know you can relate to what it feels like to have a �home country� and to have a desire to prosper and pursue happiness there.
You once said among a crowd of young students that �here in America, you write out own destiny, you make our own future� and I hope that this can one day come true when college graduates can have a realistic goal of becoming permanent residences if they work hard and believe in all that this country has to offer. When you came to Google in 2007 you told us that you would support the H1b program as well as more and faster permanent residents for those who add value to this country. Many of us here at Google as well as beyond the valley were very excited, and we remain hopeful today.
A lot of people laughed when I said that I would send you a letter. They expect me to give up. They expect that you to not read this letter. They will expect that even if you do, nothing will change.
I would like to prove them wrong. I hope that if anything, this letter will allow for a moment of consideration for actions that will speed up processing times for employment based immigration, of which many of us have already sacrificed so much for.

A lot of similar kind of efforts have been ongoing for years now with groups like IV lobbying and other individual or groups writing to their law makers, companies lobbying , writing to President etc..... Everyone is aware of the backlogs including the President himself.
While it seems to us that this is a critical issue for us, we gotta realize how politics work. Politcians are wary and cautious about stuff. Especially stuff that deals with jobs, immigration, economy etc..... which in their point of view are extremely sensitive issues.
Well, they do want to fix issues for us because they do understand the issues - it is beneficial to all parties if issues such as ours are fixed but then - this is the age of internet and fast communication and those opposing us have been able to well organize themselves (something we can never achieve) they managed to communicate effectively about how there has been misuse of visas and how a lot of Americans are without jobs and took this into a very sensitive angle. So anything that can happen to help us is being severely thwarted and leave the law makers in a status quo.
With a more pressing issue of illegal immigration and border protection - where sensitivity is extremely higher especially because the entire border protection is challenged and on the other side, there is a strong hispanic population which is a vote bank and as such Hispanics being fastest growing minority ( cannot call the community minority anymore) and more lobbying power - immigration reform is totally focussed on border protection , fraud prevention, and figuring out a way to legalize the illegal immigrants and to even start doing something towards it - the economy neeeds to get better, other issues like, enforcing border protection and fraud prevention and putting systems in place takes priority. Thats why we see ICE visits, fraud prevention from DOL etc...
What can we do - hang in there - organize ourselves, keep lobbying - and thats what we all do not do

May be this is genuine case. Below is not stated towards this case, but in general.
IF it is friend, then the representative would get answer. If the representative asks the question for himself, then the others would ask for NON-MANDATORY contribution. So some people ask question based on virutal friends.
There is another category of folks who visits this site reqularly. But they will register at the time they need an answer ( FREE OF COST) for their critical immigration question.
The last category is the one who registers and watches without posting even one question. He always reads and uses the information from this site as well as other sites.
Why is it that always friends end up in trouble in most cases?

Except for the magnetic lasso (or any other lasso) tool in Photoshop.
Quick Masking is the easiest way, but it takes a lot of time to get around the edges.
You just have to fill in the center with a big brush.... then zoom way far in (CTRL + +) and do the edges with a small brush.
Long and sometimes tedious... yes.... but worth it.

one of my friends is a researcher with a certain very common bacteria and was asked to wait 2 months before he got clearance for stamping. this happened a few years back. so apparently India is also one of the countries? one of my friends said that it is better to have letters from your supervisor or somebody really in charge that your activities are not at all in a sensitive area or that you do not handle biohazardous materials etc.

Hello everyone. I hope someone can advise me what to do. The quota for H1-B was reached before the attorney sent my petition. I went back to F1 (already was on F1 and got a B.S. in Accounting) that expires in December (attending a GMAT class), hoping for the SKILL bill to be passed. At this point it does not look like it will be passed any time soon. The employer liked my work and is willing to help me if I find a legal way to get a permission to work.
Does anyone have an idea what can be done?

Thanks I_got_skillz. So, if I were to tap into the wisdom of the crowd in this thread - guess Tulsa wouldn't be a bad option after all. One last question to all of you -- what kind of career opportunities do you have in OK? (My wife would have to quit her job in NJ). Heard about the big energy companies there.

Yes it counts a lot. I guess it is for 1-2 years, go for evaluation ASAP. I too have same from private institute plus another diploma of another year. It worked for me.

I am from mumbai and new york and used to the fast pace of life and used to seeing a lot of people. I would feel depressed if I dont get to see people. And OK is practically in the middle of nowhere. My cousin used to study there and it was very difficult to plan and make a trip to OKC from anywhere in the US. Secondly there arent many places you can go to around there. The nearest attractions are in Missouri or texas which are atleast 4- 6 hours away. Besides my other experience is with how people are with you over there. Once you have lived in the north east long enough you get used to everyone being neutral to your brown color. Not so in the midwest. I have'nt had blatant discrimination but you do get to see that people dont really like you and dont think you belong here. This played a lot on my mind and am put off by the entire mid west area in general (saw the same thing happen in knoxville, nashville, missouri etc)
Good luck on the move. My advice to you would be to make a weekend trip it might cost you 300 odd dollars but you would get a real feel for the place.

For example, my wife and I did the mistake of getting into an Italian restaurant in Boston suburb, and we were started at like martians, it was truely a horrible experience. I believe IV core team is our Dr. King. If anyone, they will be the one who will bring relief to legal immigrants. They, however, will need all the support members can give and let's hope that all members are in fact doing just that.

Bump... Lawyers, Pls. help us understand if the lawsuit is feasible. If not what is different.
I don't think the lawsuit is feasible.
Get the numbers for last 10 years for the immigrant visa numbers allocated to India/China. Since numbers are more than allocated under quota, there is no legal ground to file the lawsuit.

It appears Hyderabad consulate is looking for client letters and many more documents for H1B visa. Please refer the official link below:

I remember Murthy clarified to Chennai consulate earlier that getting client letters is not possible for H1B consultants, as most of the clients are not ready to take the burden of immigration procedures. However Hyderabad consulate starts with more requirements from its begining of service.
