At the time of filing your labor, if the job requirement is only a bachelors degree (irrespective of what the employer needs in the future years) it will be filed as EB3 only.
And logically speaking, the same employer will have no desire to redo the labor once you get the masters degree (assuming at that time, your job requirement will need a masters degree). It is unlikely that they will redo the whole process, just so that your EB3 PD is ported - this is just my opinion. However, if you get your masters and switch employers and ask them to redo your gc process and file as EB2, it might work.

I dont know about USCIS but banks have a right to refuse to honor checks which use 00/100 notation where asked to put the amount in words.
I try not to use the shortcut.
Please dont ask me to cite the source it was some radio report on my locl station some months back

I feel 0% chances for the visa recapture.
You do what ever lobbying/email/phone calls or spending, it won't happen.
Let me propose another addition to recapture bill....
Say, for every visa recapture usage number, the consumer need to pay 5K. Assume that we propose this to law makers, this also next to impossible to get passed.
I am ready to pay 5K (10K for me and wife) for every visa number I consume in recapture though my PD is EB2I- Dec05. I am sure, a calculated person of our community won't hesitate to spend this amount if he gets a visa number.

We all need to learn a lesson from you with out getting struck in to this GC SH## HOLE and stupid citizenship trap..By the time we get our citizenship, we will see some other country in super power list.
Can we make sure that the US politicans don't screw up things (e.g., national debt, immigration policy, social security, healthcare and wars all over the world to name a few)?
IMHO, very few politicians (US and India alike) worry about the country.

Hi friends,
I got a letter from BEC stating that I need to prove that I possess some skills for my Labour to be approved. The skills are Java, JSP and Servlet.
I am a Masters' degree holder from US and a Sun Certified Java Programmer.
I did courses during my MS related to Java, JSP and Servlet.
I am really perplexed why the DOL is asking me to prove my Java skills!!!
Will they accept my certification and course work syllabus? If not, how can I prove that.
It is really dissapointing since I have been waiting for Labour for 4+ years. It was filed under EB3.

Couple of my friends have had their firm audited.One of these things might happen:
1.Receive a phone call and ask about your salary,duration, whether you're getting paid on time and all those stuff
2.receive a letter with the above mentioned questions and you will have to answer them and mail it back

I am currently located in Dallas. My passport is damaged so I have to apply for a duplicate passport. I have a valid L1-B visa and also I-94. Do I have to apply separately for visa or it will automatically get stamped at the time of creating new passport? Also do I have to apply for I-94 as well. can you please help me in this regards. Can you please tell me the correct process for it. I will highly appreciate your help.

We are really looking for people who have ported to AC21 using self-employment and got their I-485 approved. Are there any real examples?. Do you know anyone out there?
santb1975, if my memory serves me right, unitednation was self employed for a period before he got his GC. I read it on the net, and as most things don't remember the link. The gist of it was: in the interview unitednation was asked about it, and he defended it successfully. But I think he was employed at the time of the GC.

What I wrote is a USCIS's way in theory. USCIS does many things which break its own laws and boundaries and it does that with every damn process all the time. So in that sense you are right as well.
