I've got an employer in the US that wants to get a Labor Certificate and apply for a green card on my behalf.
Is it possible for me to travel to the US on a tourist visa and then there apply for the green card?
Will I be allowed to stay until my application is either approved or rejected?

B1 is a non-immigrant Visa. You can at most stay for 1 year...thats the max. you cannot work on B1.
If you are eligible to apply for I485, then you can stay till the final outcome of I485. Your status would change to pending AOS.
However, I don't see a reason why you need to come over on B1. You might as well stay where you are, and process using CP.

Couple of my friends have had their firm audited.One of these things might happen:
1.Receive a phone call and ask about your salary,duration, whether you're getting paid on time and all those stuff
2.receive a letter with the above mentioned questions and you will have to answer them and mail it back

Anti american thinks Eb4 is for religious worker and they mainly engaged in worship place so it will not hurt job prospect of american but they are wrong there.. EB4 dependents can work and given GC to them they will start working.
Eb5 creates job for USA so it is out of question for opposition.
I think these two simple reasons allowing them to extend them but they are not getting extended for long term is because of His panic Caucus.
EB5 is easy to understand.
A lot of synagogue hire rabbi from Israel on religious worker category.
Yes Hispanic Caucus is powerful to hold EB2/3 hostage.
....but not powerful enough to take on that lobby.

That does not mean the officer may not again review the file based on updated data but the chances of that happening is low.
Those who have received RFE's and pre-adj. or know that they are pre-adj without RFE should be very happy knowing that their cases will be speedily approved once their PD is current.
How else do you think they issued thousands of GC's in June and July 2nd '07 -much higher than their usual levels of approving cases.

Helo All,
After IV message I want to file AOS to my dependent.
Here is my story, my AOS is filed in Dec 2004, and my kid AOS is not filed with me. My PD is 2004 Sep.
Please advise me Can I go ahead and file my kid's AOS with out my attorney who filed my AOS?
My AOS is filed by attorney and kid's AOS is going to file by me - is this gives any issue in our GC process?
Please advise me which one is best option to file AOS to my minor kid(here on H4), in July or wait for PD. One thing is recentely I got REF. Attorney has to submit evidence in next week. I am worrying that what if my AOS is get approved (i know my PD is not current, but i saw some people got approval regardless of visa bulletin)with out his AOS Submission? Please advise me.
I have no hopes from Attorney, he is not giving repsonse since July bulletin has released, even afetr revised bulletin.

I had the same question. According to discussion with my lawyer, the option to stay on H1 is a personal one. In any case you are using AC21 whether you get a new H1 for another co. or use your EAD. The advantage of being on H1 is you are still in status and working even if your 485 petition is turned down and you can apply to extend H1 (of course depending on your situation, labor filed or not, how much time left etc. etc.). But if you are on EAD you might yourself in a jam if your EAD renewal is turned down or delayed. You could be out of status. Also, if you want to go back to H1 from EAD you are back in the H1 queue (65k or 20k masters). You cannot transfer to H1 from a EAD job anymore without an approval thru a brand new filing.

All marshals were mostly local thanks to all, Thanks for arranging the accomodations Dhiren, Thanks to Sukh Praaji for all the hardwork and hauling water, flowers, placards, flags (and unlocking the Johny :)). Thanks to Arun for heading the Marshals and containing the crowd in one lane and for the safe Rally. Thanks to all the localites (Shivkanth and team) who helped out in permits and logistics. Thanks to guys who waited at monument till evening to get the stuff hauled back.

I have PGDCA from an institute in INDIA I don't if that counts.
Yes it counts a lot. I guess it is for 1-2 years, go for evaluation ASAP. I too have same from private institute plus another diploma of another year. It worked for me.
