Could you please elaborate why option 1 is dumb? What if the husband's AOS is reject for some reason. Won't the wife be left without any status? Whereas if she already has H4 then she won't be out of status just like the husband as he has H1-B. Correct me if I am wrong.

Yes, get a good lawyer. Get a second opinion as its very much possible that your current lawyer might have screwed it up and dont expect him to fess up his mishandling if there was any.
Firstly you need another lawyer to give you a second opinion, secondly you need another lawyer to find out if your current lawyer has screwed up anything so far.
Since you are well-rooted in this country with car, mortgage, school-going child, you should really dont hesitate to spend 200-300 dollars on new advice from a lawyer who knows what he is doing. Forums are only going to help you ask to right questions...to a certain extent.
You cannot rely on forums advice here from people who are really computer programmers and not immigration lawyers to decide on this important step in your career.

I think you need to look into the fact that if a child (under 18) is a US Citizen by birth, then the single provider (mother or father) can apply to become a citizen based upon that. I had a college friend from Russia who got her citizenship rather quickly based upon the fact that her child was born in the US. She did not pursue the employment based green card process.
Of course, this is anecdotal, best to confer with an attorney.

I have two cancelled passports and one current. Now that I got the latest visas on the new one, I keep the old ones in the bag (and no one asks for it).
When your visa expires, get a new visa stamp on the new passport and carry your old passport but there is low need to show it.

I see some people are waiting for 10-12 years to get a GC. At the same time others are getting it within 6 months. One of my friend from a non-retrogressed country (EB2) started his PERM in August '06 and got the card in hand in December '06. No name checks, No RFE's. I feel very happy for him but feel bad for my self. I am equally qualified but unfortunate. This is not fair.

Thanks to all the guys for the replies. My employment continues with this company. I had to swallow my ego and patch things where it was not my fault but I live to fight another day. Thanks for all the replies. I am definitely going with premium from next time. The ways things went bad in one day, the 1K is definitely worth the peace of mind.

I'm really torn (like literally) don't know which decision to make.
1. File now against EB3, hope to be able to port the EB2 140 when that comes through - if I can't do that then I'll again be stuck in retrogression.
OR,
2. Wait till the EB2 140 is approved and then file.
I'm waiting for Desi3933, he said he'll be searching for some memos that might help me.

I know it is frustrating for you, me and all of us. IV team is working hard in the background. I am not speaking for IV but this is my personal observation. While convincing the house about our provisions has been an uphill task, IV has been in the past assured that at the appropriate moment, IV's provisions will be considered in the bill but the chances of our provision(s) in the secure fence bill seem remote at this time. The reason is that once the lawmakers become accomodative to hear and consider our provisions there are 40 other parties working to get their's included as well.. the list is long... At this time the lawmakers are looking at putting the secure fence act on the president's table and would avoid having any differences on the congress and senate versions to avoid a conference. Thus they can go back to voters saying that they are working hard to secure the borders.
All that is happening at this time is election time rhetoric. No one is touching the very sensitive issue of Immigration reforms going in to the election. Everybody who matters in the DC circle wants a status quo to be maintained and spin it in the direction of " Lets secure the borders first".
Lets keep trying from all angles... media, meet the lawmakers, faxes, letters, news papers articles..atleast this is a lot better than keeping our hands folded and getting frustrated as months and years go by.

We finally got our FP notices and had some questions about process itself.
- Do we have to fill out any forms etc after reaching ASC? Or just the FP notice along with supporting documentation is enough?
- How long does the biometrics capture process itself takes?
- I am in situation where we may end up taking our little kids with us to ASC (they are not part of AOS). My wife and I have appointments one hour apart (0900 and 1000) and was wondering if kids may be permitted inside the bldg or we could take turns with them in parking lot while the other one is inside for appointments. knowing the process times may help us decide how do we handle this.
I am worried that say my wife's inside for her 0900 appointment and I'm waiting with kids and if she's not back by say 0945 - I am considered late for 1000 appointment or something like that.
Any help appreciated.

JACKSON-LEE introduced house version of CIR. HR 264.

Thank you all. I travelled back to USA on July 5 th with no H1 stamp. The officer asked 2 questions
1) What is my role?
2) How long I have been in USA?
thatz it.
And I still on H1B, my lawer said nothing needs to be done immediatly but when my new I 94 expires I have to either file new H1b or switch to AC21.

Hi All,
I had applied for canada immigration as back up in January 2007. I got the request for medicals in the mail. Does anyone know what medicals are needed. What if the TB skin test was positive. For US immigration that was no problem because X-Ray was negative.
Does a medical request mean that the case is approvable??

Did you get your IA. If they said no interview required then u are all set. Send your medicals as soon as possible and with in a month or 2 of sending your medicals you should get the passport request.

So If I m settled in India and have no US income then whatever I withdraw from my IRA would be my total income and I have to pay tax on that.
If this is the case then I think those who are very certain that they will settle in India and currently in the higher tax bracket (>25%) would save money even if they withdraw money from IRA. One can save 25% right now and pay 10% + small tax when you withdraw.

Have not been active in IV cuz of work load but have been following the IV events very closely . As luck wld have it I am in town this weekend. Anything I can do help out:
1) Printing out flyer colored/(b/w).
2) I can take a video of the event if u don;t get someone professional.
3) Call other IV members.
4) Anything else .. no mater how trivial it is.

It's a RULE to send the the EB-485 application to NSC. And that is why your lawyer sent it to NSC. NSC would transfer to TSC if needed. So do not blame your lawyer. Blame USCIS.:D
I can't blame the USCIS if the I-140 approval stated to file adjustment at "this service center", can I ?
oh how I wish I knew better. It was only through browsing this forum that I found out most of these procedures. I was naive and always trusted the lawyer to do the right thing. :rolleyes:. There are only 140k visas to go around so if I was a lawyer my best customer would be the one that keeps coming back for renewals.
