    that is wrong..i have a 7 year old and we did FP for the child and we paid for it when we paid all the other fees. Its code 2/3 for child and adults or vice versa.

    That is not wrong. Kids < 14 yrs don't pay FP fees.

    Mine is actually a bit pecular case
    Employer A filed my EB3 (PD12/04 -substution) in 2007.
    Employer A was acquired by Employer B (maintained very good relation with Emp A and B).
    Had to file AC21 with EmpB as USCIS delivered RFE.
    I changed full-time to Employer C ( Large Fortune 100 company), but they never agreed to file another EB2 and port by EB3 PD.
    I worked out with EmpB to file my EB2 and worked a deal which doesn't require transfer back to them again which they did. My labor was approved in 6 months and EB2 I140 was approved in 1 day(last month) and it retained the EB3 PD along with I485 A#.

    Since then I am waiting for an update from USCIS.

    BTW...Funny thing is that I have been always working with EmployerC first as a contractor( EmpA and EmpB) and later turned fulltime with them.

    The whole point of the GC process is that, there is a permanent job available for you at the company which sponsored your GC. If your GC is approved, you "HAVE" to work for Employer B. Though USCIS won't know whether you are working for the GC employer but it could come back and haunt you anytime in future and they could revoke your GC if they consider it as fraud.

    when did you get your GC?

    Couple of months ago. In any case, I realized I didn't do 10 years but 9 in the US although it took me more than 5 years to go green. Partly, its due to some internal organizational delays and I can't blame it all on USCIS, so consider my posts withdrawn.

    answer is fairly simple! open visa bulletine on 17th April. Till that only work, work and work!
    The result will not change, not even helps. because it wouln't be approved for all! don't increase BP, heart beat by thinking more about TSC.

    My Wife had an ITIN and I got it cancelled after I she got her SSN. Its always good to follow the documented procedure.

    I received a communication from IRS saying her ITIN has been cancelled and I should be filing the tax returns with her SSN.

    At the time of filing your labor, if the job requirement is only a bachelors degree (irrespective of what the employer needs in the future years) it will be filed as EB3 only.
    And logically speaking, the same employer will have no desire to redo the labor once you get the masters degree (assuming at that time, your job requirement will need a masters degree). It is unlikely that they will redo the whole process, just so that your EB3 PD is ported - this is just my opinion. However, if you get your masters and switch employers and ask them to redo your gc process and file as EB2, it might work.

    A person can hold multiple H1 with different employer at a given time, but should not work for multiple employers. [I do not know about part time employments]. Having multiple H1 provides choices and does not create a problem.

    As you clearly stated that your wife has no intention to work with this consulting company, you need not do anything even to cancel it. This H1 will become void automatically and she can continue to work her current employer with her existing H1. During the time of renewal, please ask submit your approved I-140 copy also for her to extend her H1 by 3 years period. [Available only if your PD is not current during her H1 renewal].

    Thank you all. I travelled back to USA on July 5 th with no H1 stamp. The officer asked 2 questions
    1) What is my role?
    2) How long I have been in USA?

    thatz it.

    And I still on H1B, my lawer said nothing needs to be done immediatly but when my new I 94 expires I have to either file new H1b or switch to AC21.

    Please, someone correct me if I am wrong...But once you enter US using AP, isn't that your H1 or H4 becomes invalid? How is that you are on H1 still?

    1. Do you see any issues with my VISA being rejected in India?

    2. I was reading on this forum that, without a visa (either expired or valid) stamp most european airlines won't even allow to board the flight, is it true?

    If this is true, what airlines should i travel with out any hessle?

    My visa stamping has expired in 2008 and my Passport is valid till Nov 2009. I got a renewal till 2012 but I didn't go for stamping yet. I also have a EAD. Would I be getting a 10 year extension of passport or only year if I apply now. I probably have to go to Newyork consulate(not sure if this impacts the renewal period of passport). I read in one of the forum that with out stamped visa we only get 1 year renewal of the passport. Is this true? Any input will be appreciated. Thanks!

    Absolutely FALSE. Renewal of passport has nothing to do with other country visas.

    I had the same question. According to discussion with my lawyer, the option to stay on H1 is a personal one. In any case you are using AC21 whether you get a new H1 for another co. or use your EAD. The advantage of being on H1 is you are still in status and working even if your 485 petition is turned down and you can apply to extend H1 (of course depending on your situation, labor filed or not, how much time left etc. etc.). But if you are on EAD you might yourself in a jam if your EAD renewal is turned down or delayed. You could be out of status. Also, if you want to go back to H1 from EAD you are back in the H1 queue (65k or 20k masters). You cannot transfer to H1 from a EAD job anymore without an approval thru a brand new filing.

    If your I-485 is turned down then you will not be able to get extensions. Reason is H1 extension past 6 years are based on pending GC. If 485 is turned down then there is not pending GC. In my case my I-140 will be revoked within 60 days so I will need to transfer H1 before that. After it is revoked I will need to restart my labor via new company and have that pending for over a year to be able to get further extensions. Otherwise I will need to use EAD after H1 expires.

    Unfortunately sometimes choosing a lawyer is not an option.... since the company provides one and you have to stick with him/her for the entire process...

    Also you need to have the PERM approved/ pending for atleast 365 days to get the 1 year extension. .


    You are wrong here...!!!! It should have been applied 365 days before the end of 6th year H1B. In other words before the start of 6th year H1b.

    I am traveling to Japan for business and then I am going to Africa for vacation. Can I go directly from Japan to Africa or do I need to come back to US, get my AP stamped and then go from US to Africa? I have an AP.

    Also are there any risks associated with traveling for vacation on AP?

    No to both. I just went to Dubai and then to India on vacation and entered with an AP with zero problems.

    dpp, after going thru the provisions in the bill, it looks like this was drafted by IV folks :)

    This bill simply addresses the specific issues that the general IV community wants relief on. I agree with you that there is nothing in this bill that should be too much of a sour pill for anti-immigration folks.

    I sincerely hope this bill would get some traction.
