    I am an ICWA from India with B.com. Degree. When I moved to US in 2001, my immigration attorney told me ICWA at best will be viewed as certification like CPA, CIA and CMA of America and will not be considered as equivalent of Degree. When I applied for H1-B, the evaluation came in as B.Com+AICWa together as equivalent of Bachelors Degree.

    However for Green card puposes each qualification individually shooul qualify as a bachelors or Masters Degree.

    WHen I processed my green card, we took EB-2 second option, which allows any certificate holder with 10 years experience in his profession with top salaries, membership and well acclaimed status in the profession qualifies for EB-2.

    Mt attorney processed my case under EB-2 second category which deals with certifications and my labor and I-140 cleared without any hassle.

    I finally got my green card in 2008.

    The bottom line is if you have 10 years experience and command high salary you have an option of using certification route.

    You can invoke AC-21 after 180 days of filing I-485 and use EAD for new employment. You can continue to be unemployed but will need to have a valid job offer in the "same or similar" category before your case is adjudicated.

    Please ensure that your ex-company does not rescind your I-140 application (at least till 180 days have elapsed from your I-485 filing). This is very critical.

    Dear IV members, I would like to share my GC story with u. I have been in the US since 2001 mostly on and off. I wasnt sure whether I want to permanently live in America and thats why I havent even thought about getting a green card before. Last year I made up my mind and applied for an employment based GC. I started my labor on January 1, 2008 (first ad in the local newspaper) and labor was applied in Fabruary. BTW I am EB2 (rest of the world). My Labor was approved in the end of April. Conccurently filed I-140 and I-485 along with AP and EAD in mid May at TSC (RD May 14 and May 20 respectively, FP done June 28 and no LUDs whatsoever after that, was a little upset over that). My birthday was on Aug 19 and what a huge present I had. I still cannot believe my luck. First on Aug 18 EAD approval followed by my I 140 approval on Aug 22 and 2 hours later I received the magic email: I-485 current status: Card production ordered!!!!!!! Unbelievable! I couldnt believe my eyes. I logged in a logged out of the USCIS website 3 times to make sure that it is not a mistake. 3 days before the approval notices I was talking to my parents telling them that I will probably wait for another 1-2 years and then I got it! No RFE no questions whatsoever. After I saw the email I felt such a relief and sense of freedom. Later in the day I spoke with my lawyer and he couldnt believe that the 485 was approved. To be honest with u I didnt even know the whole process of getting a green card (lawyer was taking care of it) before I stumbled on the Immigration Voice website after a google search. I have followed all of the threads for the last 7-8 months here and I find them extremely helpful and a great source of information. Sorry for the long post and I wish you all to get your green cards from the bottom of my heart. My 8 months are nothing compared to some of you who have been waiting for years so my advice is to spend a lot of money on a good lawyer and hope for the best, the rest of it is in God's hands. Thank you for reading my post and God Bless America!

    Congratulations!! Enjoy your freedom. Unfortunately, your advice does not hold good for India / China, we have to deal with racist rules even though we are in a employment based category. If just having a good expensive lawyer would get someone a green card, Indians and Chinese immigrants would be on top of the list as most of them are among the top 20% highly paid professionals in America. Oh well.. Have fun and continue supporting IV !

    In I140 the employer has to prove 2 things
    - ability to pay you
    - you are qualified for the position.

    Even though the company is paying you less, there are several ways you can prove and get the case approved. You will need a good lawyer and a CPA to help you. Your company has 40 employees so it is not very small. How many H1bs are there and how many people have applied for GCs. This is important to know. there is a very informative thread on immigrationportal and one user- unitednations has posted valuable information. you may want to go through the entire thread.

    In all there are only 5 H1B's in the company and this is their first PERM/GC filing. Company is not a desi consulting company. Only 2 other employees will apply for GC but company will apply for PERM only after my case is cleared for I-140.In fact this is the first GC case. I have a question regarding salary to be paid and actual salary being paid. Do the company has pay the proferred wages from day PERM is filed or the day I-485 is filed? Another question is: though the perm was filed for BS+5, which should be EB2, If company files I-140 in EB3, will it affect the outcome in any poisitve way. Right now, I need I-140 approval for three year extension. Other options can be considered latter.

    They had posted I-129, and I-539 dates sometime in Apr, May 2007 :eek: in all the service centers !! I refreshed the page few times just to double check.. The date on top was as of August 15, 2008 but the I-129 and I-539 dates were in 2007!!!!

    Now they are back to 2008.. phew..

    Looks like data entry operator entered 2007 earlier and later corrected it. :mad:

    Anyways, lets hope we get some good news next month for I-485 dates.

    Hi all,

    I don't want to type a long story here telling all my ex-employer frauds and their policies. I pretty much know that I am victim. All I am asking me is to please provide me with the details of the officials i can approach to report the fraud( I wasn't paid 15 days salary though I worked on those days). They are simply refusing to provide me with the final paycheck though I gave the month notice that is required before resigning. Can I report to USCIS officials regarding this fraud? Can I sue them? :mad:

    Great posts by all. But still my original question is not replied. Let me repharse it.

    When I know that it is going to take 7-10 years for USCIS to even open my I-485 application for adjudication process in the mean time can I work on EAD in whatever position I want and at the time of adjudication join my employer for this future job (for which I-140 is approved) or if it is available at that time then use AC21 provison and start working as a "Programmer Analyst" for a month or so with this new employer and provide EVL from new job?

    This is not much clear to me.

    I believe since GC is for future job, it is alright to use EAD in the meantime for whatever job (I mean any kind of job even like a chef) as long as I can prove that I have intentions to work with this future employer as soon as my I-485 gets approved. I know my employer will not revoke I-140 any time.


    I am asking this because so many people say they have to take a job with the same or similar job description but I believe the point in time is not now but when USCIS approaches the time frame for I-485 adjudication only then.

    Please tell me if I am correct or incorrect.

    Understand what you're saying. But how will you know when exactly they do the adjustment? Are they going to tell u in advance, a month or two ago? If it is matter of years fine. But you never know how these guys work. They may approve some case not even in order! People already noticed this in trackkit.

    I think you would be fine. They have no grounds to reject your case. As far as ability to pay is concerned, you are getting paid regularly since last three years, so that also should not be an issue either.

    thanks for your response, I am a regular member of this site, this site is very helpful for all of us who are striving for the same goal.
    I recieved RFE for quite a few things, following are highlights of my RFE.

    * Educational Qualification (provided my evaluation and all the degrees). I am also a CISSP (certified information security professional) which is a requirement for my current position that I am working on

    Ability to pay.

    Relationship with the employer ( they have asked my and my employer to write a statement that my employer and I dont have familial relationship. This is because my employer was Vice President of company A which went under in 2002, he started his own company B and offered me job, which I accepted and transfered my H1 to company B. I am still with company B. Company B also happened to be a small company now consists of 15 employees with some major contracts in federal sector.

    Past Experience

    I have provided all the information based on the RFE , company tax returns for the past 3 year ( obviously they are not very strong as company is in business for only 3 years now) my pay stubs which proves that I am getting the pay which I suppose to get from my employer. My job title is Information and network Security Specialist and I am working in a Federal agency and I have necessary background investigation and clearance to work in federal agency. I am not from the 4 retrogressed countries and in EB3 catagory which I dont think is matter since everybody is retrogressed now.
    Also does any body know a good lawyer in Washington DC area, I am pretty happy with my lawyer but just in case.

    Its seems like my life of 7 years is going down the drain and no way out. I am really looking towards all of you for your guidance.

    I contacted with my local congressman office and asked them to inquire
    my name check status. I attach the reply. Is the true that ask
    congressman to contact with FBI will delay the name check?

    No problem. We will contact the FBI.

    Just be aware that each time the FBI is contacted to check a name they
    will add that information to their data base and when the USCIS sends
    fingerprints your name will get more than one hit which mean that your
    name will not be clear for immigration benefits until the FBI does a
    manual check on every hit.

    3 to 4 years is normal processing time by FBI if a name has one or more
    hits.

    Read their info to make sure you want this office to send your request
    to the FBI.

This is recession time and one can ask for some help/guidance from a highly skilled group of people on IV.
