Who needs GC
If people think that life back in india or in their home country is better than the US then why are they lining up in the GC queue.
Do not take GC as convenience, it has much more value.. Your children are safe, You do not have to bribe the telephone, electricity department to provide the facilities to your house in America. Basic necessities are provided without any hassle
1)The world economy runs on the US economy.
2) OIL is traded in US dollars and will always be that way so that there is always a flow and need of the dollar.
3) Oil is the cheapest in this country except the oil bearing countries.
4)You have jobs in every field here. In India the IT sector is coming up. Other sectors are at the same level.
The list is long so .... It is not a convenience...
The best point brought about in this whole discussion. We all know getting a GC is not easy. Its harder than it should be and contradictory to the principles that shapes the US. It is enscribed on Lady Liberty "Bring your tired, your sick, your meek and your poor... etc." Now it seems like, "we don't even want your most talented to stay here.. they can work here.. but that's about it..."
We all want a GC for the convenience of Travel, career mobility, global mobility and for the lifestyle that comes with all of those things. The US has its problems, but you will get steady power, steady water, safe roads, advancement opportunities, entrepreneurial opportunities, etc.
Let me tell you how it works in a former Soviet republic... if the power is on - great, its off - horrible.. if you want to live anywhere remotely liveable with amenities you will pay an arm and a leg... you want to take out your savings - tough break, the bank CFO is actually an Assemblyman's son and he has wired all Deposit interest accounts to a Zurich and has himself fled; someone hits your car because they ran a stop sign - you are out of luck because that guy knows the prosecutor's son and all of a sudden you are at fault and have to pay for his car, you want to start your business - prepare to pay bribes to government inspectors every month otherwise they will bust you, prepare for a 90% tax bracket, prepare for some oligarch to come along and offer you cents on the dollar for your business and muscle you right out..
THe list can go on forever... we all want a green card so that we and our offspring and eve relatives have a better life... should it be easier? YES! But we have to deal with what we have and use the system to our advantage..

Gurus,
Please help me. I need some advice from you guys. Currently, I am staying in US on H4 visa and recently I got admission in one of the US universities with full funding and so I want to convert my visa status from H4 to F1. Now regarding this I have the following questions:
1. It seems that visa COS from H4 to F1 takes anywhere from 2 months to 6 months, so my chances are 50/50 of getting it approved for Fall 2008. So, is it advisable to seek an F1 visa from India?
2. If I go to India and try to get F1 visa from there, what are my chances of approval considering that my husband is working in US on H1B visa (potential immigrant and all) as he also came on F1 visa and now working here (we have not filed for green card yet).
3. In case my F1 visa got denied in India, can I come back to US on my existing H4 visa and then apply for COS from here or will they revoke my H4 visa in India?
Your timely response is much appreciated.
Thanks.
Technically your F1 visa does not need to be in place before you start your classes, except if the funding depends on it .
My son changed status from H4 to F1 some time back. He had already been in college on his H4 and he changed status and still continued classes as if nothing happened. It took about three months or so to be approved but essentially a very straightforward process.
It is not clear why you WANT to change status when it is not necessary since you can study on an H4??

You wrote, //Yes. Applicant can use the earliest PD for any approved I-140s and with the highest category for any I-140. In your case, after your second I-140 is approved, you can claim PD of eB2 Oct 2004.
Again, you can claim PD of eb2 Oct 2004 after second I-140 is approved.//
My PD for EB2 is not Oct 2004, it is Jun 2006.
Again,
EB2 - PD Jun 2006, I-140 pending.
EB3 - PD Oct 2004, I-140 approved.
I understand that an alien can use the earliest PD irrespective of the EB category in case of multiple approved I-140s. However, my case is different in that I want to port the EB category itself (I think - I don't fully understand yet).
If I file I-485 using EB3 category, I'll have the PD of Oct 2004 automatically. Knowing that I'll retain the PD of Oct 2004, will I be able to request INS to substitute the EB3 I-140 with the EB2 I-140?

Got some good news this afternoon! The W7 got approved and my wife got an ITIN number assigned!
She will not get ITIN number unless she enters US. You canot file Joint return. It has to be single.
So the above post has been proved incorrect. Wife never entered the US and yet she now has gotten the ITIN number. :p Just wanted to note this down in case someone else has a similar issue .

I have received the following RFE for my H1B Visa, we are waiting for detailed document, following is the text from USCIS website. Please suggest me, what should I do.
On March 9, 2010, we mailed a notice requesting additional evidence or information in this case I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
A request for evidence is made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant's eligibility for the benefit sought. We may send you a request for evidence at any stage of our review. The request will indicate what evidence or information is needed for us to fully evaluate your application or petition. The notice will explain where to send the evidence and will give the deadline for your response. Your application or petition will be held in suspense during that time. If you receive a request for evidence and have questions about what you need to submit, you may call our National Customer Service Center at 1-800-375-5283.

Guys,
This is what I will do on January 1st,2007 or the 2nd if I have a hangover:
1. I will compile a relatively short letter explaining my story and how the retrogression affects me, my family and many like me. The letter will also explain how retrogression works, and what would be the intermin fix for the EB catogories.
2. I will MAIL this letter to each and every senator. (regular mail) I guess I can afford post stamps...:-))
3. I will wait a week and re-mail this letter to every senator again.
4. I will wait another week and will send another one again to all senators, no exceptions to those who are pro-and con immigrants..
5. Finally, I will mail this letter to the president; also several times.
Guys, can you imagine how many letters the senators would get if everyone of our members did the same what I will do? That would be thousands of letters. I guess, we can afford for paying post stamps, cannot we? Obviously, we are skilled and we earn some $s... .
I urge you to do the same! I will keep you posted when I mail the letters!
Please do the same. If only 30% of the letters get to the senators and they read them, let's say 10% of them will react somehow. I guess it is an excellent idea I will pursue to help me and the others affected by this stupid broken imm system.
:)
Regards,
G

Thanks. Do you the answer to the other question?
Is this the final pending count or are there unaccounted numbers somewhere else?
Nothing's final in case of numbers ( anywhere ) . You see that no EB3 has been able to file for 485 since August 2007 . In the last three four years a number of folks with PD 2007 and before might have gotten married and may need to file for their spouses and waiting for their PD to be current.
Then there are cases in which EB3 port to EB2.
Then there are cases in which people abandon their GC and go back or lose their job and the companies withdraw the GC applications.
A number of factors come in .
But the inventory sheet will give you a broad accuracy and a good estimate.

What does that meant "withdrawal acknowledgment notice"? Did you request for i-485 originals to be sent to you?
Hi Gurus,
I have got an email update today against my 485 which says that
Current Status: Withdrawal Acknowledgment Notice Sent. I changed my job after 8 months of filing my 485. No body sent any withdraw application on my behalf or myself. Please advise, what i should do now...
Thanks

This is really bad; who sends the application first are the people having more wait. I know someone who filed on 2nd july and application reached on 2nd july and received by someother person there at NSC at 9.30am has received the receipt already. please any one whose application was received by B GERKENSMEYER and has recceived any update please post it here.
Hi all,
my application was sent to B GERKENSMEYER and my checks got cashed yesterday and the SRC number is on the back of the check.
i had sent the application to NSC and it was transferred to TSC as it says my application is at TSC.
I have 140 pending from TSC.
so may be this means that B GERKENSMEYER has not really messed up on the stamp thing.
