Please click to read the thread and please please send letters ASAP. It is very easy, just print 4 pages, put in envelop and mail them. I already did and so many others, but we do need more letters. This is less than $2, well spent for our future. Do share with others in same boat! Thanks a lot brother!

It is really heartening to see the movement towards getting the Tristate members together and having our voices heard.
IV is not just a website, but an organization with a mission and a goal, vision for all our future. It is a grass roots organization based on volunteer efforts and its people like you and me that will make it work.
That IV is a source of reliable, legit information is well established. But it'd be important to understand that the information is available because of a lot of hard work.
We all have different strengths, and it's okay if you can't participate in one way, but then share your skills with IV in another way. We have a Tristate Yahoo group. Please join that, and let's start sharing ideas. The first goal should be to have more of us join the effort and become active IV members.

Congratulations on getting your GC.
Unfortunately spending money on lawyers will not solve this problem, my lawyer also very good and he charged a lot. But you know the problem USCIS, if they are not touching I would say forget where they put my application, how lawyer can help me?

Dear IV members, I would like to share my GC story with u. I have been in the US since 2001 mostly on and off. I wasnt sure whether I want to permanently live in America and thats why I havent even thought about getting a green card before. Last year I made up my mind and applied for an employment based GC. I started my labor on January 1, 2008 (first ad in the local newspaper) and labor was applied in Fabruary. BTW I am EB2 (rest of the world). My Labor was approved in the end of April. Conccurently filed I-140 and I-485 along with AP and EAD in mid May at TSC (RD May 14 and May 20 respectively, FP done June 28 and no LUDs whatsoever after that, was a little upset over that). My birthday was on Aug 19 and what a huge present I had. I still cannot believe my luck. First on Aug 18 EAD approval followed by my I 140 approval on Aug 22 and 2 hours later I received the magic email: I-485 current status: Card production ordered!!!!!!! Unbelievable! I couldnt believe my eyes. I logged in a logged out of the USCIS website 3 times to make sure that it is not a mistake. 3 days before the approval notices I was talking to my parents telling them that I will probably wait for another 1-2 years and then I got it! No RFE no questions whatsoever. After I saw the email I felt such a relief and sense of freedom. Later in the day I spoke with my lawyer and he couldnt believe that the 485 was approved. To be honest with u I didnt even know the whole process of getting a green card (lawyer was taking care of it) before I stumbled on the Immigration Voice website after a google search. I have followed all of the threads for the last 7-8 months here and I find them extremely helpful and a great source of information. Sorry for the long post and I wish you all to get your green cards from the bottom of my heart. My 8 months are nothing compared to some of you who have been waiting for years so my advice is to spend a lot of money on a good lawyer and hope for the best, the rest of it is in God's hands. Most of these calls are originated from Skype in the guise of US calls and they don't even spare cell numbers. The Do Not Call registry is specifically for land lines and tele marketers are not supposed to call any cell number by law.
The accent and communication of these telemarketers is so bad and many a time they don't know what they're asking for. They just a waste your time, cell phone minutes and money and derive pleasure out of it. At times they even leave blank voice mails.
They're specifically targeting Indians in US and I strongly suspect reliance indiacall in releasing our primary phone numbers to desi marketers. How do i know? I had recently changed my cell phone number and had updated the same in with reliance indiacall. Within weeks I started getting these marketing calls from an area code in Iowa.
Unfortunately, nothing can be done to stop these calls and the best way to tackle these people is to ignore their calls. I did that and they stopped calling me after few days.

Can H4 to F-1 COS be applied anytime?
i.e. Can one start MS (or MBA) on H4 and then at anytime apply for COS to F-1? OR can this be applied only when one semester end and another starts?
H-4 does not need full time course load, while F-1 does... hence wonder if one can apply for H-4 to F-1 in the middle of a semester...(when one is taking less than full time course load on H4)
I am thinking about using the H4 to F-1 COS in case of layoff risks for the H1 primary holder. (Have the EAD option, but can't keep H4 in status).

A lot of things can be done. A good start is to organize various events like meet and greets through state chapters, bring in more people, inclucate a sense of "oneness" - baby sit people on unity and try to make people feel a sense for the community. Develop business networking, help with job networks, help with immigration issues etc....
We as a comunity MUST grow stronger otherwise we will keep facing issues.

Aman, first of all I thank you from bottom of my heart for the selfless dedicated work. You are fighting for our cause and may God shower his choicest blessings on you and the core team.
I have closely worked with IAFPE on one previous occasion and also informed one core team member about this organization last year with some details of my good experience with them. With their 22 state chapters and their experince in working with politicians, this organization has what it takes to a make a difference in this mission. If all these chapters become active on retrogression issue, we would achieve our goal earlier than we believe. Thanks to IAFPE for invitation to IV to participate in the annual event. We need more help from Indain American community.

Read the string of USCIS memo relating to this and you will see why I ask this question.
I spoke to an IO this morning and he says that you don't have to pay any fee in the following two cases:
1) If you have filed under new structure
2) If you have paid $340/$305 once (renewals are free thereon)
he thinks that the EAD/Ap adjudicators are not completely informed regarding the waiver of fees as it applies to the new fee structure.
And ....Yes, I wish to save money.
I do not understand the point of your question (leave alone you sending twice the application without fee)! [ You are quoting every time this also: 5. (c)(9) or (c)(16) Adjustment applicant who filed for adjustment under the fee structure implemented July 30, 2007."]

Actually it never became an issue, because labor backlog meant everyone got screwed equally and there was no retrogression in the EB visa stage... so quotas really did not have much effect. But now they do.
We can say... look a candidate from Zambia with the same qualification as the one from India gets his green card in 2 years but the one from India has to wait 5-6 years just because of his country of birth. That hurts the businesses too. I am sure at least some lawmakers will see the unfairness.
not with soft caps right? with soft caps the one from India would wait a quarter longer if there's any leftover from the WW category.
