If I were you, then I will do the below:
ASSUMPTION: I have not married and if I know I will get married only after a year or two then,
1. I will apply for AOS now. After six months, invoke AC21 and find a better job.
2. I will stay on EAD until a month before I get married.
3. I will switch to H1 back from EAD through my present employer and get married and bring my wife on h4 and will stay on H1 until my date becomes current. If my wife can get some H1, then I will invoke my EAD etc etc. If one can switch so easily from EAD back to H1, then why do lawyers ask someone to try and maintain their H1 be status throughout the GC process?

Asking to recapture 90K unused visas will get our PD's near respectable dates and will also help Schedule workers. This is probably the least we can ask for ?

Looks like senators are already lining up for amendments. Hope if anything like recapturing is on the desk, then it will be distributed across the spectrum rather than letting it trickle down.

Looks like TSC is processing Nov- Dec 05 PD cases. This means that we may see some movement in EB2 in coming months.

Not just India. Most countries in the world has some form of protection for their country citizens. India and China does not have shortage of skills but always have shortage of jobs because of population. But USA has shortage of skills in many areas. When that will be addressed they may ask us to Pack our bags and or they may reduce the number of immigrants.

My employer advised that since its the discretion of an IO to approve/deny and how long they will extend or not - lets not ask them to change for anything. One interesting thing is the extension is exactly upto the date when the 2 Yr EAD validity ends as well ( if they extend my EAD by 2 yrs this time)
It may be just a coincidence or may be it could be something purposeful because otherwise 2yr 8 months is a wierd time frame - If its a mistake by IO that I-140 is approved instead of pending he/she would have extended by 3 years - why some time frame like 2 yr 8 months ?

I think all those things were OK when economy was good. Now the table has turned. It gives them more justifying reason to object on self-employment. My opinion.

The company I used to work for earlier was a consulting company and whenever I go to India for stamping (Chennai) the company used to send me all these docs - everything in a bundle and I used to take them to consulate.
I went for stamping 2 times through that company, first time they asked me to show ONLY my tax returns and paystubs and asked me what I do and also recent paystubs and I got the visa.
Second time I went for an extension - they never bothered to see any document, they straight away issued the visa though I carried all documents listed.
Consuulting companies have to be ready to give you all documents needed and I do not see an issue.
If you are in a project - get letter from client manager - how difficult is it?

Update on my travel exp. Del to JFK. Was only traveling with one copy of AP as per lawyer was told to leave one with family member in u.s.
Delhi Airport. No problems from Air India staff. They seemed well informed. Immigration officer though at IGI didn't seem knowledgeable and I had to explain. He went on to his supervisor who was asking why I didn't have 2 copies of AP (one for them...why do they need one???). I told her I only got one and was told by lawyer to travel with copies and had that for her if she needed. She didn't and returned my AP to me. Had to go through security again right before boarding aircraft and thankfully that IO didn't question me again though he seemed bit confused and read the whole AP text.

I explained I didn't fill out questions 12 and 13 on landing card since I didn't know answer as traveling first time on AP. he had no prob with that. He flipped through passport and saw H1b visa (expired) and I explained it's expired. He asked "so you applied for GC", me "yes". He was very nice and we chatted a bit about GC delays and he commented that H1bs should get priority on getting GC as country needs more talented people but it's up to the govt to make laws. He explained secondary inspection and after biometrics I went to secondary inspection. I was only person there. Within 7 mins done. No questions asked.
MY AP stamped with "paroled" and valid for one year from today (arrival day, July 2011) whereas my AP actually expires on Feb 2011.....
All I'd needed to show was my passport and AP though I was also carrying other docs like EVL and EAD.
So all went smoothly....

I do not think that DoS or USCIS will agree to this. The last time they messed up, there was a huge fallout. This time around, they know the pending numbers and will be very cautious by moving the dates. They cannot move the dates for EB2 alone. They will have to do so for EB3 too. And when that happens, July 2007 repeats itself.
To get a grip on the number of applications that are eligible to file for 485, USCIS was planning on implementing a process where you have to register to indicate you want to file a 485. They are going to use those numbers to move the dates. Dont know what happened to that move.
So, rather than waste your efforts in trying to get USCIS/DoS to budge, work towards a comprehensive solution by lobbying for a change in law.
The change is only administrative. So the visa dates do not move. USCIS will allow all to file for I485 when PD is not current.. That is what we are fighting for.
A comprehensive solution is what everybody wants. But that is not possible untill after the mid-term elections in Nov.

I think you either misunderstood your lawyer or making some mistakes.
You do not need to reapply I-485 for sure. USCIS does not promote applying I-485 multiple times. You just need to port the priority date in new I-140. Doing so will not obsolete your EB3 application. In other words, your EB3 application will be still counted along with your EB2 application.

Form does not have ITIN column. And you can not write ITIN in field meant for SSN.

But remember, businesses are run by capitalists. As the CNBC video suggests, they don't want to be told how to run their business, especially, companies who havenot received any bailout money.
