180 days is it from the Postmark date (ex Jul 2nd when USCIS recd it in the mail) or is it the Notice date (thats on your RN when they opened it)??

I am sure nobody in house or senate oppose these small items. Please core members go for these following items in lameduck session. Do not wait just move forward.

My Employer is willing to provide a letter with all the contents above in blue color. They will not write any matter in the EVL about immigration or anything related to that. It will be a plain EVL with job description, salary and Position.
I am concerned about this section of the AC21 RFE: The letter should also indicate whether the terms and conditions of your employment-based visa petition (or labor certification) continue to exist.
Is there anyone out there who sent such an AC21 letter? I just got approved for my H-1B extension (after 6 years), but in the immigration letter , it states my current status is "Cable sent to American Consulate or port of entry notifying them of approval", which means I need to go back to my country and come back here. That is what my lawyer said.
But the problem is if I go back, there is big possibilty that consulate reject my request. I have a wife and a 4 year-old daughter here. My family only rely on my income. and also I have home mortgage, car loan, and phone bill, utility fee to pay, etc. If I am rejected, how does my family survive?
Anybody has similar problem before, how to solve it? or any better idea?

we got a letter from bar council stating that their regulations require to have a SSN to apply for the bar exam. That letter along with a copy of the regulation got her the SSN with not valid for work stamped on it.

My attorney sent me the originals of I-485 receipts a few days after sending me the scanned copies. Here's the message the attorney sent me:
We have learned that more and more immigration examiner/inspectors are requesting presentation of the original I-485 receipts at the time of re-entry. Thus, I have mailed to your home address the original I-485 receipts for you and for your wife via first class mail. Please carry the original I-485 receipts when traveling abroad. However, you should only present them when requested by an immigration officer.

From what I remember, the status will change "Approval notice sent" in a couple of days and then u should be getting the card in the mail. I would say a week max to get the card

I can just about hear the headline on Lou Dobbs, "H1bs buying greencards, which should after all be a priviledge and not a comodity for trade on wall street."
AILA will never support this and will matter of factly lobby against it behind the scenes, the more mess and confusion and delays in the system the more work for them. The only reason they support increasing EB numbers is that on the net effect (faster processing vs increased volume of applications) they come out ahead. This is always the case with lawyers, they are exceptional at looking after the interests of their profession and in this case you are asking them to cut the hands that feed them.
All in all, it is a great idea but will never fly in my view and furthermore will be construed in a negative light. It will backfire.

1) You can use EAD to work for any company in any profession (yes, you can work on it at McDonalds if things get tough).
2) You need to have a job offer in a similar profession to change your sponsoring employer on the AOS petition - that can only be done after Jan 19. This whole thing is independent of who you work for on your H1 or EAD.
3) Start looking for a new job immediately. If your old employer terminates you and cancels your H1 and I-140, you will have very little time to transfer your H1 to a new employer (withdrawal of I-140 will trigger denial of I-485, which will invalidate your EAD). You will also be without any fallback status if your H1 and AOS are canceled.
4) Your best bet is to transfer H1 to a new employer because H1 is independent of what happens to your AOS case.
Try to leave the employer on good terms (like, if you find a new job and leave to their satisfaction). They will be less likely to look for ways to hurt you. Good luck!

Thanks mwin - Are there any USCIS or DOL laws which state that i have a right to get copies of all these docs like LCA, 129, withdrawal letter, etc...! even though i will not work for that employer.!!...Should i worry about this pending H1B especially when my wife already has her current H1B valid...Would extension on this current H1b be a problem.?? Thank you!
Yes, you could request copies of such documents from any government agency by making a FOIA request. Freedom of Information Act requires the government to disclose any documents (with certain exceptions) they have in your file.

This is not necessarily true. Gold will go down in price and that is for sure, but its not going to happen soon. Bull markets when they begin tend to stay on until the public gets a smell of it and drive the prices higher; once that happens ; thats the peak of that cycle. You will recognize the peak when you see it and you would know it.
Demand / Supply fundamentals are out of whack for Gold, Silver and other commodities.
Overall Investment Demand for Gold is high and supply has remained the same for the last few years. Commodities Investing is the trend for next few years until excess supply overcomes demand.

#1 - It is advisible to have your spouse name added to your password. I have seen instances for newly married couple, where the US consulate have refused to issue a nonimmigrant visa (under 221g) just because the spouse name not in the passport and submit the passport after the spouse name is added.
#2 - ECNR stands for Emigration Clearance Not Required, you will be able to obtain this if you have a education of 3 year Diploma and Higher. If you do not have ECNR, you will have to obtain clearance first before you travel otherwise in the immigration check the would not allow you board the plane.

All my questions were answered with in 10 mts, and I asked same questions in different words just to make use of the time.
Finally I cut the call before 5 or 6 minutes earlier since there was nothing to ask.

i DID this..I did work for L1 company even after my H1b approved and applied H1b ext and went for 2 times stamping..
There should not be a problem to work on L1 even after h1b approved. It all goes by i-94 validity on your l1 visa.
Even though you did this(I also did this), it's not the right way. All this could be an issue during 485 processing. If by any chance USCIS finds out that you are in wrong status, then they could deport you.
YOU HAVE TO GO BY WHATEVER YOUR LATEST I-94 SAYS.

I am on my 6th year of H1B (NIV Expiration Sept 2011) Visa. My I-140 was approved in 2008 and have been waiting to file for I-485 since then. I have recently learnt of layoffs in my company planned beginning Jan 2011. Instead of letting that happen, I want to be proactive and see if I can find another employer. What are my options? Can I switch employers without having filed for I-485?

I was in somewhat similar situation a while back.. Due to my own fault my I-94 was getting expired (before my actual visa) and I was on my 5th yr. Instead of re capturing the H1 time from vacation, etc my lawyer filed my labor under premium process and got I-140 approved in 10 days. Based on that approved I-140 she applied for my H1 extension.
Anyway, going back to your point, I would discuss these points i.e. PP for H1 followed by PP for labor upfront with the future employer, as you can not afford to waist any time.
My only concern is that while filing for I-140 PP is easy but the actual preparation of documents, etc takes time. This includes news paper ad, interview, etc.. This can easily take 3 to 4 months. But on the bright side your employer might already have done this for the existing job opening.
