I went to the rally today. One person "looked drunk" was shouting at us to go back to our country, and a very old lady "90" in a tour bus, gave me a thump down. But never the less a lot of people cheered for us and honk thier horns to support us. I wished there was some clear and big sighn shows we are LEGAL here, not ILLEGAL. I bit a lot people didn't understand the diffrence including the senator who gave the speech.

Yes, I have copies of Medical Reports for US immigration that were done in july. My concern is that TB skin test shows positive and then they did chest x-ray and that shows negative. Is that going to cause problem?
Also, can I take the medical report from US immigration and hopefully, if I can get the actual X-Ray, would that save me money for Canada immigration medical?
They dont do skin test for TB. The skin test is not a positive test. It tests

Thanks all those who participated in the discussions.
I found one tip- it is that whatever number they posted on the website don't dial that, but start dialing numbers by decreasing 1 and/or increasing 1. Most likely these numbers will be belonging to the same office. This way you could reach someone live in that office and then you have request that person to help and explain the problem that no one is picking phone u have already dial 100 times..most likely he/she will help.
I used this approach today and it worked for me.
Beside all of this I am writing an email to home misters and overseas Indian ministry that why the Indian consulate in USA functions in such a unprofessional and disrespectful manner to its own citizens.

This is really bad; who sends the application first are the people having more wait. I know someone who filed on 2nd july and application reached on 2nd july and received by someother person there at NSC at 9.30am has received the receipt already. please any one whose application was received by B GERKENSMEYER and has recceived any update please post it here.

#1 - It is advisible to have your spouse name added to your password. I have seen instances for newly married couple, where the US consulate have refused to issue a nonimmigrant visa (under 221g) just because the spouse name not in the passport and submit the passport after the spouse name is added.
#2 - ECNR stands for Emigration Clearance Not Required, you will be able to obtain this if you have a education of 3 year Diploma and Higher. If you do not have ECNR, you will have to obtain clearance first before you travel otherwise in the immigration check the would not allow you board the plane.

They received it the next day 7/20

I don't see any calculator in the above link. My EB3 PD is June 2003. Anyone has a guess when EB3 would reach that date ?
I am planning on filing new EB2 perm application as I lost hope on EB3 (Employer agreed). Though priority date can be ported over, with the backlogs on PERM process, it looks like it might take anywhere from 6 to 18 months for this process. Do you think moving to EB2 is a wise move ?
Is there any chance that EB3 June 2003 PD will be current before the end of this year ? Any thoughts would probably help in making a decision from my side. Thanks.

I dont know about USCIS but banks have a right to refuse to honor checks which use 00/100 notation where asked to put the amount in words.
I try not to use the shortcut.
Please dont ask me to cite the source it was some radio report on my locl station some months back

Tough Competition: Yes, but for contracting positions not for fulltime. This coming year is going to be very tough for BA/Tester jobs because of two factors, H4 converted to EAD, and new H1b comers who either arrived or coming in Jan and then apply for social and join the line. Coaches will train these and get their sweet cut. Every year its same but this year force is bigger (H1 + EAD). Both will impact entry level jobs 1-3 year experience.
Recession: We already entered into recession without knowing it. Ask about recession who faced last recession 2000-2003. This will be little better than previous for IT, because in 2001 recession folks who entered US market between 1997-99 as Y2K experts (3-6 months diploma folks, don�t tell me there are none, I know some who are now managers and directors and still knows nothing about IT) had no jobs from Jan 2000. Going back to native country was not acceptable and had no competencies to survive without new technologies. They started polluting market by taking any possible job at any rate. Thankfully we don�t have those people. So job market will shrink and the no#1 rule/cause of recession �survival of fittest� will serve the purpose.

Its an open secret how desi consulting companies manipulate resumes for submission to end-clients. Its not uncommon these days to see ads for Java/.NET/SAP/BA/QA training and placements. Such shops first train H1/H4/EAD holders and then create customized resumes (matching skills and years of experience) for contracting/permanent positions based on the job requirement. There is always somebody available to help answer technical questions during the telephone interview followed by on the job technical support if the candidate is accepted for the contracting position. Imagine being a good candidate having real experience and competing with such newcomers. They can outsmart you and end up getting the contracting position with the kind of telephonic interview support they get.
My suggestion would be to keep improving your technical skills no matter whether you are in permanent or contracting position. Additionally, if you are a Bachelors degree holder, get a Masters in Science or MBA degree. Even the American recruiters and companies now realize how resumes are manipulated and candidates helped during interviews. Quite a few now stress on face to face interviews and background checks. Having a US Masters or expertise in the technical skills can help you with recession.

Most of the people with approved I-140 / Labor are not as informative as the members here. I have few friends with approved I-140 don't even know what the PD means and what are the benefits of Pending I-485. I had to push them to talk to their lawyers, prepare the papers like birth certificates and medical etc...
So don't think most will be ready for monday filing... Only very few will take this advantage and mail for monday delivery...

Regardless of how you get the Damaged Passport/VISA situation resolved, should'nt you inform your counsel that you have travelled outside the country and re-entered (legally, of course).
1) When you applied for VISA re-validation did you mention that a immigrant petition has been filed for you with USCIS and you are waiting on action.
2) Your I-485 petition would have recorded your latest I-94, last date of entry, VISA stamp number etc., in the petition. All this info is now changed since you have a new VISA stamp, I-94 & newer date/port of entry different from what was recorded on your pending AOS petition.
Regardless of how you feel about what the counsel might say regarding travelling and re-entering against their advise, I think you should always keep the counsel in the loop and provide them with the most accurate and current information so that they can help you in case of a RFE or address any other issues with your application down the line. It does'nt help your cause or theirs when you deliberately supress information...That's like shooting yourself in the foot...

Can you suggest how is Porting done if I-485 are already filed under EB-3. Do you have to file another set of I-485s. Or you just need new Labor & I-140 ?

My understanding is when FP is done they take all fingers of one particular hand once and then individual fingers later for the same hand.
The Match (%) is for match between all the fingers taken at once and then individually.
And they need to Match 50-60% or more, and thats why retries are done when Match is not found or is a low percent match. For Fingers that match the prior finger print (for full hand) comes up with Match Found! not an error but indicator for the person doing the FP to move ahead with other fingers.
It has nothing to do with any database at that point of time.
Which is so logic, keep it up !!
