I believe the new job has to be in same/similar occupation as the old one for which I-140 was approved. Does anyone know how same/similar is defined ?
Does it mean the same job category/code under which the LC was filed. Or should it have the exact same job description (very difficult :o ) ?

I am so sorry to hear that badluck. I can imagine just how you feel. When the July bulletin went bust on July 2, that is all I could think about. Why is it that whenever I try to do something, my luck stops me? I asked myself this question many times.
This year (from January) has just been one disaster after another for myself and my family. BUT be positive , as far as we have life .. there is hope for another day!

Just a thought - my lawyer - a big firm was severely vilified in previous posts in IV. Also, being big, they will care little for the value of a banner ad.
Their marketing modus operandi has always been to capture decisions from senior executives.
My current lawyer is always inquisitive about how i get some info before they do.
My employer and lawyer is very tightly connected and i have never been able to have a glimpse into my labor or get a hard copy of my I140.
Overall, i am sure, IV will not be seen in a good light by the people i deal with.
i am refraining from this action until IV core suggests otherwise specifically.

Why is that ? I thought EAD & AP went hand in hand.
H1b will only be considered valid when its stamped (even if you enter on AP). If you dont have a valid stamped h1b then it will be considered abandoned...H1b is dual intent.

Finally, some checks have cleared yesterday.. but I-140 check not cashed yet.. My application was sent to NSC.. the receipt numbers start with SRC so they must have been transferred to TSC...

I understand your frustration.
Firstly, IMHO, calling our contributions to IV as a donation is not the right word. I think IV must reword Donation to something else, so that people don't feel like they are doing a charity.
Secondly, fwiw, I can vouch for IV and guarantee you that there's no cheating here and nobody is stealing your money. There was no fine-print anywhere. There could be a lapse on some individuals, but that's understandable as everyone is like you & me working full-time elsewhere on a VISA in this country.
Lastly, folks have just come back from hectic advocacy days, give them a week to look at your issue. I'm sure there would be a way-around. fwiw, I'm waiting for my account to be enabled as well:)

"The Labor Department is auditing all pending applications for legal immigrant workers the firm has filed on behalf of its corporate clients." so the bad cases which were approved go scott free while valuable resources are tied down in investigating pending applications. eventually its the immigrants who suffer. Fragoman, if guilty, will pay the fine and blame it on some low rung individuals and the perm process will slow down for all due to the extra scrutiny. :rolleyes:

will add that information to their data base and when the USCIS sends
fingerprints your name will get more than one hit which mean that your
name will not be clear for immigration benefits until the FBI does a
manual check on every hit.
3 to 4 years is normal processing time by FBI if a name has one or more
hits.

Looks like quite some people struck in this situation. When I called TSC, the response I got was, case is not within the processing times. In that case, howcome they processed my case and most of the people getting all together.
As for as everything going good, there will be no problem. If there is any struckup, it is very difficult to work with CIS.
I am not sure how much Infopass going to help.

Is anyone in the same position?
As my priority date is 2003 I was eligible to apply in June. So I was in a rush and finished all my paper work, medical and got the set ready and delivered to my company in May itself. They reviewed my papers and asked for more proof and signatures ! which too i sent in very promptly.. In June 1st week my papers were reviewed and ready to be filed.. I dont (& will never) really get what made them delay my matter so much .. I followed with them and the only ans I got is 'we will let you know once filed!'
Then 2nd morning my attorney people informed that they sent the papers thro courier and once the bulletin was out on July 2nd , they retrieved the documents the very same day!!
Now.. I am in a fix not able to move on with my life and my travel to my home country (as i have just crossed 6 yrs in H1)
Now, I want to file in July so that tomo if USCIS decides to take in july filers, then I will get thro' but my company is very clear and they are plain refusing to file. Is it right on their part to do so? or can I file seperately?
I now dont know whom to fight with -company / Uscis??
Please let me know if someone is in the same situation and have some recourse / suggestions!
