Can we have a plan to tackle this SKIL bill as we have always done before?
Let group over self State wise. Let�s see how many people can come up with each state.
Let�s for an example I am from Ohio, If I can get 10+ more people. I can drive to Columbus. Each senator has one representative for Immigration issue. We have to hand it over to him and them follow up with him to make sure that our voice is heard.
It has to be a coordinated effort. I myself can get 150 signs in a petition. I am sure every Indian and Chinese and Philippines and Mexican will sign the petition.
If I do it alone the voice is not heard. It has to be uniform effort.
Let�s mail a letter and allow where I can print and get the signature and Address and we can personally go and hand it over.
If we can do it at least in 20-25 state that is more than enough to make them aware. Please let us know.

I was at Milpitas gathering tonight. Here is a question I wanted to ask there, but ran out of time.
Most of the immigration related bills introduced in house/senate we thought would pass were denied because one or two clauses in there that they didn't like. Is it possible to exclude stuff like increasing H1 visas and include it in a separate bill; that we may have better chance in getting green card bills passed.
It was just my thought.

One my friends told me that he had 11 H1B approvals during 1999. There are no restrictions on the number of H1B approvals one can have. I know people working part time on one H1 and full time on another.

What about all that BS that if one does not start work by Oct 1st 2007 then one could be out of status. etc.....My wife will be contiuing with her full time H1B JOB with CAP EXEPMPT employer which she has had now for 4 years..! Her H1 is already valid till march and her employer has already said that they will extend h1 too for remaining 2 years.! I mean if the consulting company refuses to co-operate with us by not sending the letter to withdraw the new H1 peitition then it really is his loss... isn't it..??...Are there any USCIS or DOL laws which state that i have a right to get copies of all these docs like LCA, 129, letter, etc...! even though i will not work for that employer.!..I mean there should be something protecting us right..!!

I heard there is a difference between MTR and Appeal, which one better to buy the time.

i would also suggest to start another perm right away. you can get 1 year H1 extension based on labor.
however you existing case is similar to mine. you should appeal the decision but by law USCIS looks for 3 things.
1) your salary is same or more what lobor says at the time of labor filing. ( at that point it doesn't really matter if finacial are weak or strong or even if company has only $100 in their account)
2) company's profit must be more than prevailing wage at the time labor filing.
3) if not above 2 then company must have strong assets.
USCIS normally accept audited financials ot tax returns. audited financials are done through CPA or audit firm.

Sen: The arrows on your helix coil don't work properly anymore. I dunno if it's just me, but when I'm at the picture display page and I want to focus on a certain picture, I click the arrow to scroll the helix and it does nothing.

Hi Folks, I am in the process of switching from EB-3 to EB-2 myself. The key to filing EB-2 vs. EB-3 is the qualifications required by the position, NOT the qualifications possessed by the candidate. You might have a Ph.D and 25 years experience, but if you're being hired for a Computer Programmer position, you cannot file EB-2.
How do you know if your position is EB-2 eligible? You can look on the DoL foreign labor certification website (www.flcdatacenter.org), for your job category, if it says Job Zone 5 or higher, the position qualifies for EB-2. I have heard that certain Job Zone 4 positions have qualified for EB-2, such as "senior software enginer" or "senior systems analyst", however I have been advised by two different lawyers at two different firms that this is not the case.
You can only amend your I-140, like the previous poster stated, *IF* the original labor certification was for a position that would normally qualify for EB-2 (e.g., "Computer Information Systems Manager" - Job Zone 5) and for some reason your dumbass lawyer filed as EB-3. Otherwise, if your labor certification is for a position that would normally only qualify for EB-3, your employer/sponsor will need to come up with a new position that *does* qualify for EB-2 and then you have to restart the entire process.

Hello All,
I went DDS , GA for renewal of my licence which is going to expiere on 10/26/08. DDS of GA is implementing SAVE programme. Initially they wanted me to come back after five days as they could not get instant verification of my approved EAD. I went after five days and again they asked me come after 30 business days period, as my verfication of EAD is under 3 rd level. Couple of my freinds has the similar problem with the GA DDS. Since my driver liecen is expiring what I should be doing. I am so confused and BTW what is the penalty if drive with expiered licence in GA.

I am on EB2 with PD dec 2006 and will be filing for 485 and i140 is pending. Being single and marriage date not sure, i may not got much benifitted by EAD/AP. I still have 3 years of h1b. I work for a non profit organization on IT side ..good thing is very secure and very easy to get GC. Bad part is pay not competativ enough with private companies all though good enough to lead a good life in US.
I have got H1b done from a consultancy and now i am the delema to jump to private company or not as i still have 3 years of H1b. But the very fact that i need to go thru al the process of GC again makes me think twice. The fear fo regretting is making me not to take chance as the 485 dates became current. Also i feel i can alaways think of climbing the career ladder after GC. In brief i am bit confused as i have many options.
I would apprecite if you throw suggestions on this situation.
Although eventually i will take the decsion which is good for me.
