"Army Recruiter's main job is to get you in the army by any means. ." With this statement I meant recruiter wont discourage you not to join Army. Point what ych003 made was you will be deployed if you join this program. That is not true once your DHS is approved. ARMY recruitement treat you as regular enlistee. And then you have to go through all the process and procedures as a regular enlistee do in US.
After your trainings you will be assigned to a unit based on that MOS you choose and who needs based on your MOS. Plus Army ask you to fill a list of station you want to go and it is 100% that you will be assigned to first 10 stations you filled up in that case. But if you are in a MOS and the unit that is needed in unstable country then you have to go. But that does not mean if you are a utility speciality will go for infantry. You will working on the base which would be far away from the battlefield. But if you are in armor, infantary etc then you have to do your job on field.

Hi, yes, I can start work, but problem is I can't start work for a different reason. I wont be having medical license issued to me until 1-2 month after finishing my current job ( residency ).. and without license, I can't start the new job..! that is the reason, I will be unemployed ( having gap in between jobs ) for 1-2 months. any solution to that? is it valid?

As an avid student of computer science - I have a belief that I understand the 'law's governing human cognition - and, by extension, how the world works - and yet, by another extension, how it 'should' work. Not a very atypical belief among us, Indian forum-fighters - huh!
My theory is named the "conservation of instant gratification". When we are all babies - we all need instant gratification. Waiting for something is simply a concept as alien to babies as discussing without insinuation and snide remarks is to Indian forum fighters. When we grow up - our life trains us to suppress this animal urge for instant gratification. But we are, after all, evolved from animals. i.e. we ARE animals who need instant gratification. So how to get it?
Simple, Americans get it by spending what they dont have. That is meterialistic instant gratification. Who cares about saving and thinking about long term? And we Indians - deeply rooted into a culture of thrift and conservativeness - only have the avenue of intellectual self gratification. Heck - it feels great to score a point in argument. Who cares about trying to understand the other point of view?
So guys - keep fighting! Its quite entertaining for us forum-lurkers.

Ok, I just got the RFEs from my lawyer:
For my wife, it just appears she needs to update her medical examination results. The civil surgeon forgot to put the date for the lab test they did that proves that she is immune to varicella.
For me, we need to provide additional confirmation of your current employment, and employment history with my current employer.
I have not ported my case from another employer, else they have asked for more proof.
I've attached the 2 RFE for those that are interested... hopefully it might help someone!

Let me explain personal experience. exit with old ap and get into new AP.
In 2008 My wife left to India with old AP. and came back with new AP(it was approved when she is in India). Nobody questioned on this. I think they will see only AP is valid or not. Thats it.
Don't worry. Just enjoy your vacation.

As far as I understand, you need a valid license before you can apply for H-1b. However, you can apply for your ABIM board examination and use the exam registration to apply for extension of your current visa status. That will give you time to sort out your license and then you can apply for H-1b.

TCS employees give into it. When people know the implications and issues with the company why join such companies?
I have interacted with employees from Infosys, TCS, Satyam, Wipro .... all Indian companies ... many have issues, low pay, long work hours, immobility. Once again this proves that Indians (as we are) give into it. We do have a mindset of "adjusting to the situation" and think "getting exploited" is a part of life.
The way these companies do business is also not great. They give client free programmers and attract clients for low billing rates and lowe rates. They provide 1 consultant free for every 4 consultants. What a life these people have?????? Where is growth and where is professionalism?????
Before we actually blame the companies, the employees must educate themsleves and their co workers. A lot of people I know at TCS, when they left the company, they used to carry letterheads with them and get reference letter from a friend as company won't give.
Dear friends, please educate your co workers, and friends working in these companies, ask them to be aware of their rights.

if visa numbers are available then it should go to the retrogressed country.
there are about 40,000 visas for EB3 for entire world.
and if you look at demand, other countries hardly has any. so
ultimately a lot of visas from those 40,000 should come to india.

Even though an employer pays the attorney and may have a long standing professional relationship with the attorney, if the attorney enters an appearance on behalf of an employee and/or provides legal advice to the employee, an attorney-client relationship between the attorney and the employee exists and the attorney has an equal ethical obligation to both the employer and the employee. So, in up-guy's situation, the attorney's refusal to share documents including copies of the I-140 and LC constitutes an ethical violation which if reported to the state disciplinary authorities would most likely result in sanctions against the attorney.

My employer is a constulting company and recently they got H1 approved and got visa also. I got my extension in oct 2008 and did not got my visa stamped as i did not travelled but now my wife and kids travel and they stuck there now.
I have to verify for wage determination yet.. but should not be problem.I am on a project right now.
221(g) is rampant in India nowadays for IT consulting companies.

They wont start before join. Thats for sure. Nowadays no company is doing green card as future employee.
What if the company says ' we will file green card on day one' and they dont do it. Will you look for another job imemdiately. Think about it. Its like slow poisoning. They feed you with slow poisoning. They wont file your green card and you dont wont come out of that company since its secured. Finally you have to leave this country with tears and without green card. My experience is saying this.
Take risks, Work as consultant, drive as slong as you can, fly as far as you can. Spend quality time with family whenever you can, file green card as soon as you can .

I have read different opinions, comments and thoughts from several forums pertaining to non-immigrants opening bussiness. Sometimes, I wonder where all these come from. Isn't there an official publication/guideline by the USCIS on this??? Who knows?
