He can do traditional IRA every year without any income restrictions. So yes technically he can do it for both 2009 (before April) and 2010. No he CANNOT contribute to Roth IRA, because of his income, BUT he can CONVERT his old Rollover/Traditional IRA to Roth this year and pay taxes in two installments one this year and the next in 2011.

the growing budget deficit and falling dollar is sooner or later going to do two things. 1. rate of inflation would be high 2. Loss in consumer confidence, resulting in the recession.

Same fortune 500 company the whole time except the first 3 months. Still waiting for GC. All of my friends are Citizens and most of them went back for good.
I guess I will have to wait for another 3 months to 5 years depending on how (un)lucky I am.

No need to jump directly to the lawsuit, although that is a final option. We can start out by educating the lawmakers how quotas are discriminatory and against the spirit of "Equal protection". I do not fall in this category... but I surely support any such initiative. I can imagine the pain involved in keeping the legal status for that long without AOS...
I wanted to keep using my H1B and my first attempt to renew my H1B left me with a H1B approval without I-94... if not for AOS, I might have been stuck in India in the name of administrative delays in H1b stamping.

Hi - my 485 was tranfered to VSC from TSC last December. Their processing date for 485 is July 2006 :mad:! When TSC is already showing April 2007. Why would they load balance to a SC that is so far behind? Anything I can do to get the case moved back?? Has anybody else been transfered to VSC?

3 times the minimum wage for a skilled -worker is not unreasonable at all in the US. It comes to roughly 47K. How reasonable this factor of three in Europe I don't know. 60 (??) days of paid vacation, great culture and food (experience limited to Spain, Italy and Switzerland) sounds great actually. If only Blue card were a reality. On the other hand I love this country and the opportunities I got here to pursue my dream.

My employer and I have started the processing of my green card and we already have the Certified Form 9089. Before we file for I-140, we would like to know if this is an EB2 or EB3 category so we can use the interim rule on the concurrent filing of I-140 and I-485.
Here are some information:
Employer: Private Technical/Vocational School
Job Information: Medical Technology Instructor (NAICS Code 611519)
Minimum requirement: Bachelor of Science in Medical Technology(BSMT), 2 years experience, Masters degree preferred
Employee Information: BSMT (graduated 1990), with 10 years experience , Doctor of Medicine (1999); Currently on H1B visa-extended (will expire 2008) with the same employer

Guys. As of July 30th people have to file the I-485 as per the jurisdiction of the service center.

Also as per the above USCIS update people can start filing accoording to the jurisdiction in advance of the July 30 effective date as well.
So till July 29th (including) if one files it at NSC there is no guarantee it will stay there as they generally have done a 50-50 load balancing of cases received at NSC irrespective of where the I-140 was approved (I know several who fit this case) This will no longer be applicable starting July 30th.

One of my friend, he came here last DEC 2005 from India through Atlanta based consulting company. My friend paid for his H1, he paid for Air ticket to come here. The company never gives any support to find his project. They did not give him accommodation and relocation. NOTHING from the company side for the past 1-year� we friends helped him by providing accommodation and food. By this FEB end his H1 is going to over (first 2 1/2 years approximately, he came after one year from approval). The company is not helping him by applying extension. Now he got one job, his company is not willing to sign the contract for this project. (Reason: They have to apply for extension, But they are telling their attorney advice them not to sign the contract since he is here for an year without their support, that will give a problem to the company). There is no other way for my friend other than to transfer his H1 to some other (good) company� but He doesn�t have a pay slip� What to do? The entire fault is from the company side, but my friend is suffering. (He spend his H1 cost + Air ticket for nothing�) Is there any solution for him? Please kindly advice /suggestions and Ideas�

I had the same question. According to discussion with my lawyer, the option to stay on H1 is a personal one. In any case you are using AC21 whether you get a new H1 for another co. or use your EAD. The advantage of being on H1 is you are still in status and working even if your 485 petition is turned down and you can apply to extend H1 (of course depending on your situation, labor filed or not, how much time left etc. etc.). But if you are on EAD you might yourself in a jam if your EAD renewal is turned down or delayed. You could be out of status. Also, if you want to go back to H1 from EAD you are back in the H1 queue (65k or 20k masters). You cannot transfer to H1 from a EAD job anymore without an approval thru a brand new filing.
Are you sure about not being able to transfer H1 from EAD? If you have already finished your 6 yrs on h1B, then that is true ... but if you have some years left on H1B, then you could use those years without going through the quota.

Please realize , what you are asking for is not a paid service to guarantee? Agree?
There are already provisions for some applications where you can pay and expedite your application... This is not like that.
We are all here trying to get attention to our problems from those who matter.
Please appreciate this Team efforts.

Folks ...
(1) Majority of members on this site and every other immi site are people who filled 485. Its just simple because those are the people who have wait so long and need more advise for EAD , AP , AC21 , H1b renewal with AP and so on..... I am not only saying that those AOS fillers are not interested in pre filling but also there is lack of interest in people who didnot file AOS and have nothing to do with immigration right now.. NO EAD , NO AP renewal... etc..
(2) Majority of people in this world are selfish.( Count me in too ). Thus people will be more interested for AC21 , AP renewal , EAD renewal. etc..
(3) We need lobbying and huge money. ( Even IV is struggling for money with 30k members ( again 80 % of them are AOS filler whose spouse can work now..)
(4) Personal experience... ( I was the one who started survey in March... didnot go beyod as got response from some 50 users... Not enough people folks.)
with all these conditions... I believe only VISA RECAPTURE will work.It will clear old people from queue ( Now USCIS has almost 165k pre adjusted 485s ) . and give opportunity to us for AOS filling.
Now when VISA recapture will happen....
If CIR happens and we are added into CIR. Other than it just enjoy summer !!!! and sleep for 2-3 years ... as USCIS is now waiting for EB visa numbers and they may change their processing focus on some another load.

Billu, don't do that mistake. If they are lucky then they will get in if not then the consulate will simply cancel their appointment and ask them to reapply again. In that case, they will have to pay for the visa fees all over again and go through the entire process. I think you should take this issue to your local congressman and the senator. That is the best solution and I do not think IV will do anything for this since this is completely an administration issue with the Delhi Consulate. Summer time and too many people are applying for the visa and less staffs at the consulate too.
So do not select English and ask for a translator.
Speaking by experience..Delhi/Mumbai always has translators..thats just how it works there..the only way to get an appointment is to take it in English..go there and ask for a translator..no senator/anyone else can help in this matter..it's pretty straight forward..good luck..
