Yes, one of my colleague got fired. He was on 6th year of H1b with Labor pending for more than 365 days. With few paychecks first he changed his status to B1 and then it took 6 months for him to find a job and then he used pending labor to get 1 year H1b extension and now he is apply for GC via PERM etc.

SKIL will only be a backup plan if CIR fails. The good thing is that there is such a backup plan.
Like I said before, we wish that SKIL comes to the floor.
But BEFORE the CIR is dead and its eulogy is read by all the pundits in the media and politicians, Frist will never table SKIL on the floor, which deals with 10% of immigration issues(Hi-skills legal immigration only) and does not deal with current illegals, guest-worker program, border security, interior enforcement, employer obligations, family based backlogs etc. . CIR has to die first if SKIL has to come to the floor of the senate.
So the earliest that SKIL could be floored, debated and voted on in the senate would be June. But not before memorial day, since they would be working on CIR until memorial day. So if CIR cannot pass the senate between 16th and memorial day, then and ONLY THEN, Frist would listen to Cornyn and table the SKIL bill.
Republicans are under tremendous pressure to deliver on immigration. If they dont deal with it this year before the elections, then the issue of immigration faces the voters and Republicans lose conservative base who think they are liberal on immigration and and also lose latino population that would be dissatisfied with their non-performance. In that case, they can also kiss the Latino vote good-bye for the next 20 years.(look what happened to California governor in the past who proposed a ballot initiative against illegal immigration in 1994, california legislature has been under Dem control since and Republicans never really recovered over there). So I guess Frist will have to deliver. I dont know what RNC has in its plans to convince Sensenbrenner to do with immigration reform. As pointed out by many experts, Republicans are looking at a lot of trouble in November if they fail to deliver CIR, both from Latino vote base and conservative vote base.

My colleague is from Russia and he told that his process went in-parallel. I know for them visa number is current.
So rest of the process follows only after filing I-485? is this correct? and I can easily shift my case to another??

This is what I would do:
3 year H1 --> 140 --> 485
1. Get a job in another company and transfer H1. Currently the job market is pretty hot. So, you may have to dust your resume and move to another job asap. Since your PD is not current, you will get 3 year H1 with the new guy.
2. Labor/140 thru new guy.
3. 485 on your own or keep a close watch on what the employer is doing. (I think I do not have to tell you this, since you have already burned your fingers once.).
Don't worry; be happy. When one window closes, a door opens in your life. Have a beer, find some good friends, take a small vacation.

I called the Buffalo department of labor(federal). She took all my details and ex-employer details. She said that she will follow up with them and ask them to send the check. TSC claims to be processing AP within a 90 days timeframe, mine has already be 95 days and not a single LUD yet!! When I called the IO, he said it is the average time frame and in real time it could be a lot delayed as there are numerous applications pending! They are currently done with June 20th cases completely...
This is insane, if they know where they are at, they should have posted it correctly in the processing times link ..they are misguiding us and causing a lot of unnecessary tension! I will have to cancel my airtickets as I dont think I'll even have a LUD in AP before Nov 3rd!!!

You are assuming everyone in EB3 has only a bachelors and everyone in EB2 has a US masters - neither part of the assumption is correct. Remember, the EB system is employer -driver. Therefore, your category depends on not just your educational qualifications, but also what your employer says are the minimum qualifications for that position. Consequently, lots of EB3 folks on this forum do have a US masters, but since their position requires only a bachelors, they end up in EB3. When these exemptions from SKIL/STRIVE come into force, all such folks will be out of the queue - whether they are in EB2 or EB3. now doesn't that benefit those folks who dont have a masters ?
And BTW, if you have 5+ years of US experience, you still can qualify for an EB2 even without a masters. This whole idea of "I am not masters, therefore I have little to gain" is myopic in my opinion.
No offense to US Educated folks who had the opportunity and blessings to come here for higher studies. I'm happy for them, something is better than nothing. I think the vast majority of folks in this community might be folks with NO US Higher Education. Will this bill do any good to these folks ? Though we have no US Education, we still have 6,7, 8+ years of US Work experience. Although provision to exclude US Educated from the EB visa numbers, etc� might help, I do not think would eliminate the current problem although it might ease a little bit, Doubt if it would make any difference at all for EB3 folks. This is only convienient for those who work in NYC that too this is during weekday.What I feel is it should be in weekend that too in a place where it is convienient for the most of the people in NY/NJ/CT area.If I have come from Albany,NY along with Wife and Kid and I guess there are many members who are in my situation.Bear Mountain, NY.I guess It's convienient for most of the people.for me It's 2 hrs drive.Correct me I am wrong.

ITIN cannot be applied separately from the tax return. They have to be done at the same time and mailed in together (1040 + W7).
The way I did it was that I used HRBlock to fill out all my information online, and instead of e-filing, I printed out the return. Make sure that you leave the SSN field blank for your wife since that's where the ITIN will be assigned. HR Block online site did not allow me to leave it blank so I did a 'jugaad' :) I filled it out with the text 123456789, and then after saving it to pdf, I used a pdf editor to blank out the field, and then finally printed it out.
Now fill out the W7, put everything including your joint filer tax return in one envelope and send to the appropriate address and you should be good to go.

I need Green Card and I need it now.
Yesterday, on my way back from work I was listening to the NPR. They were covering the story(ies) about over burden immigration system in US. In the yesterday�s story they covered a family (of course originally from Mexico) in the Philadelphia. All the family member (Father, wife & kids-US citizens etc.) came to US illegally and all of them have a green card but this guy did not have GC yet. This guy got caught when driving on the suspended driving license (three times DUI). He said he was driving his sick daughter to the doctor. Well the cops send him to the prison and then to hands him to the Immigration Authorities for the deportation. He was moved to Texas in the Immigration Prison. But his family fought back (with the help of other organizations that help illegal immigrants). Another thing none of them speak English. Now he is out of prison moved back with his family. I am sure he will be caught again for DUI and will get his GC before me.
Here is my story.

Paying State & Fed Taxes from 10 years
Not any thing else but only 2 speeding tickets

This EB system is FUCKED UP and it really does sucks. Now I think, I should have come to US illegally and have enjoyed the all the benefits of (not paying taxes, hogging the federal resources, and finally getting the GC and then Citizenship before any other EB applicant.)
