I was thinking, in the world of Americal law (legal language), do they have something like STAY? I think that is the easiest way to go, something which would immediately disapprove the VB updates in july.

I was thinking of getting cashier's checks made to DHS. I'm not too sure if personal checks are accepted - I've never read about anyone submitting personal checks to DHS, have you?
I filed on my own I539 (for H4) for wife with Personal Cheque. It has been encashed by USCIS. So I dont think personal cheque is an issue.

Do you have any idea on what basis they transfer the case from NSC to TSC?
Yes. basis = none.
They randomly sent some apps to TSC and some to CSC to reduce load in NSC. There are some people on these forums trying to discern some logic and identify a pattern based on location, I-140 approval ,etc, but all that is simply a waste of time for there is no pattern here.

Isn't Plus Pilot program for concurrent filers who's PD is current? I saw some cases I-140 and I-485 approved on the same day.

I was also in the same situation , my EAD is expiring next week but i got mine last week and i did not have 90 days. I approached Congressman and i got it through him. I am not sure why that rought is not working for you.
try to call the congressman again and explain him the situation of loosing job, family to be supported etc. and see what they say.

Folks, all this is good, you are taking it upon yourselves, which is praise worthy. But I just see a fundamental flaw, we just do not have numbers.
I fail to understand why any congressman/woman would even bother about a minority group like ours.
Even the Civil rights movements in the 1960s had something for the politicians, in their case the newly empowered African American citizens could immediately vote. In our case new permanent residents cannot immediately vote, nor can they sway Indian immigrants who are US citizens.
At the end of it we have nothing to offer in terms of votes.
More than expecting CIR or anything, I want to pose this EB backlog as a question to the President, Janet Napolitano, and ask them whose fault is it? I just want to understand the reasoning, the justification. Is it my fault that I come from a land of a billion souls? Is it my fault that I chose to chase the American Dream?
Your PD is 2008. The EB2/3 India backlog "train-wreck" was in full swing by that time. I understand that PD of 2003/2004/2005 were caught off guard. To some extend you knew what you were getting into.

Thanks everybody...We feel terrible that we let the consulting company down..They helped us when we needed this H1 stuff..! And now we filed for AOS/EAD...But then what to do...Everything was so circumstantial.! S**t happens u know.!! Sometimes we have no control.! We have offerred to pay for expenses (filing fees + attorney fees) + something called DAMAGE FEES of $1000...$%%@?? thats a total of $3500.!
We're doing this in good faith & to keep it clean.! We feel responsible for letting them down.! ...THERE'S THE REAL WORLD & THEN THE IMMIGRATION WORLD..!!

that is wrong..i have a 7 year old and we did FP for the child and we paid for it when we paid all the other fees. Its code 2/3 for child and adults or vice versa.

From data it seems like Nebraska is firing at all cylinders and Texas is stuck in 1st gear for EB2 cases. I read Googler's post, while it makes sense it still does not explain why there are so few cases being approved from TSC as compared to NSC.
Any insights into this anomaly?
