On the bright side it appears that for EB2, there is no demand for Cases prior to January 2006 for India
This makes me infer (not sure if I am right) that all 2005 cases for EB2 India have either been addressed or there are sufficient visas to provide and take care of them
This makes me further guess that the EB2 priority date may at the worst regress to January 01, 2006 in the Oct Visa bulletin
Any thoughts?

Not all of them in h1b are applying gc. Top 5 H1B Indian companies TCS,CTS Wipro,Satyam and Infosys are not processing GC. So less than 40% of people only apply gc. In that some of them are not serious. So if 650k people comes on H1b Only 200 to 300k people should have applied Gc. 70% of H1b persons are Eb3. So EB3 is in very bad shape. Also no adjustment was done for H1B increase from 2001 to 2004 to 195K. If some temporary relief is done by giving one time increase of 100k to 200k gc will make PD picture much brighter

I would never believe I know better than an immigration expert such as Rajiv Khanna. However, this issue became prominent after 9/11 and there were dozens of people whose spouse died in the towers who were in adjustment of status process. They had US citizen children etc etc.
It is my understanding that a ruling took place that in such circumstances the dependent could still stay here and become permanent resident.
I have no links to post but remember this being a hot topic. Maybe a search in the immigration sites regarding this horrible situation.
My heart goes out to this lady and child. Bad enough losing ones spouse but having to leave your home too is just plain wrong.

Dear IV members, I would like to share my GC story with u. I have been in the US since 2001 mostly on and off. I wasnt sure whether I want to permanently live in America and thats why I havent even thought about getting a green card before. Last year I made up my mind and applied for an employment based GC. I started my labor on January 1, 2008 (first ad in the local newspaper) and labor was applied in Fabruary. BTW I am EB2 (rest of the world). My Labor was approved in the end of April. Conccurently filed I-140 and I-485 along with AP and EAD in mid May at TSC (RD May 14 and May 20 respectively, FP done June 28 and no LUDs whatsoever after that, was a little upset over that). My birthday was on Aug 19 and what a huge present I had. I still cannot believe my luck. First on Aug 18 EAD approval followed by my I 140 approval on Aug 22 and 2 hours later I received the magic email: I-485 current status: Card production ordered!!!!!!! Unbelievable! I couldnt believe my eyes. I logged in a logged out of the USCIS website 3 times to make sure that it is not a mistake. 3 days before the approval notices I was talking to my parents telling them that I will probably wait for another 1-2 years and then I got it! No RFE no questions whatsoever. After I saw the email I felt such a relief and sense of freedom. Later in the day I spoke with my lawyer and he couldnt believe that the 485 was approved. To be honest with u I didnt even know the whole process of getting a green card (lawyer was taking care of it) before I stumbled on the Immigration Voice website after a google search. I have followed all of the threads for the last 7-8 months here and I find them extremely helpful and a great source of information. Sorry for the long post and I wish you all to get your green cards from the bottom of my heart. My 8 months are nothing compared to some of you who have been waiting for years so my advice is to spend a lot of money on a good lawyer and hope for the best, the rest of it is in God's hands. btw my theory is that TSC is going by the date that shows up on the online status (date when they entered ur data into the system). Not by PD/RD/ND.
So for example 249=Aug 17 System Entry Date which has not yet been approved.

Can H4 to F-1 COS be applied anytime?
i.e. Can one start MS (or MBA) on H4 and then at anytime apply for COS to F-1? OR can this be applied only when one semester end and another starts?
H-4 does not need full time course load, while F-1 does... hence wonder if one can apply for H-4 to F-1 in the middle of a semester...(when one is taking less than full time course load on H4)
I am thinking about using the H4 to F-1 COS in case of layoff risks for the H1 primary holder. (Have the EAD option, but can't keep H4 in status).

What is 'C' company? I have heard of 'D' company (Dawood Ibrahim Company).
'D' Company does not file Green Cards for sure!!
You will get a 3 year extension with new employer as your I-140 is approved with your current employer.
Mar-08 may not be current in next year to file for 485. So the new employer will have 1-2 years to apply for labor and I-140 for you and you still wont lose your number in the queue or miss the boat. Make sure they port your priority date when applying for I-140.

Thank you all for the kind words. I just want to mention another thing about having a good lawyer during the green card process. I insisted that my lawyer dedicates a decent amount of time writing the cover letter (that hasnt been discussed widely in the forum) because a good cover letter helps avoid common RFE on both I-140 and I-485. I had multiple visas (J-1, F-1, B-2) before I applied for the GC and I strongly believe that the extensive cover letter cleared many of the questions that an IO might have had regarding my stay and activities in the US. Other than that I believe my paperwork was perfect and it is pure luck that it got picked up so fast.
On another note I also insisted before my employer that my personal lawyer handles my case. I did not want a company lawyer to be involved because they tend to be very evasive about everything you ask regarding the case and they also represent more or less my employers interests rather than mine.
As a matter of fact I wanted to apply for the GC last year but my lawyer told me that there is a big retrogression from previous years and that the USCIS had a timeframe until Sep 30 to put everything in order. For that purpose they hired over 2000 new employees. I dont know how much they helped but at least USCIS is doing something to eliminate the backlogs which affect so many people which PD is current.

answer is yes, cos, we got it done for my child. i think there is a small difference for the children that, they dont take finger prints of all the fingers, i think just the index finger.

You can always apply....whether you will get it is a different issue....
Also remember you can only stay for 6 months in the US under the terms of the tourist visa(per visit).....so if you are any of the EB categories you will have to go back and come back again.
Also your tourist visa can get denied if the GC is initiated before you get it as its non-immigrant visa........
above is my opinion but you should always consult a lawyer.......
In any case you will not be able to work until you get your work authorization either way..........
I have a little doubt on this. To apply GC when you are in US, you should have entered in US with dual intent visa category. H1 & L1 are dual intent. I am not sure visitor visa is.... ?
